Hi to all at the forum 44

Can anyone advise on any of these questions?



Q1. If you register you sale contract at the Land office can a Mortgage Still be put on the land or any of the buildings on that land after the registration date?

Has that ever happened ?



Q2. If a Mortgage was put on the land before a Sale Contract was registered how will you will know this fact and how do you find this information yourself.

Ref Q2 also when you go to the land registry to register your contract they will let you know if there is any outstanding mortgages/charges etc on your land or property.

Q1 - Not that I'm aware of but registration of contracts was only introduced in Jan 2008.



Q2 - This will be identified when the contract is registered. The signatory has to sign a declaration to the effect that they have been made aware of any encumbrance.



Ask whoever registered your contract or get a search done at the Lands Office.

Happy jack,



Registration of contracts is now compulsory and must be registered at District Land Registry within 21 days of execution.



Your contract should clearly indicate that the sale of the property, usually the land, is free from encumberance.



Any encumberances should be registered at land registry. If any charges exhist,these will be highlighted when a district Land search is undertaken by yourself or your advocate. You may consider doing several,over a period of time.



I believe that registration of mortgages, encumberances, charges and contracts of sale is now far better than it was pre January 2008.



However, You must be happy that your developer will honour any contract that it is party too. I advise that you involve yourself as much as possible in any purchase project in order to keep the waggon rolling in the correct direction.

Can anyone advice me if there is a current problem with registering property. A frien of our is currently trying to register her property with the land office is Girne, and says that the Government has closed the office. Is this the case??

A neighbour of mine went there on Tuesday to do a search and it was open then. I don't think they do much in the afternoons though so best to go early.
