| Dear Teatime re msg 3 Can you show me your source for the "sentencing tarrif" you suggest, pleaee My info is that ABH - could mean UP TO five years if the case went to Crown Court - i.e Jury Trial ( 7 if racial motivation) .. Can't see Affray being listed as more "serious" re length of sentence...but *could* be the same tariff, but more often less. Seems that I was wrong to call the charge lessor ! |

| mmmmmmm OK, we were both partly right on this one, it's 7 years for 'Ringleader' in affray. But, apparently, talking to someone used to these things, affray is far easier to prove in court. | Hi Teatime, re msg 6 Having been on the receiving end of an ABH and Common Assault charge 5 years ago, I put myself in situation where I had to defend myself amongst "hostile" witnesses .. I ( sadly ) know how the CPS ( Crown Prosecution Services) work... they play a percentage game... I can WELL imagine they would take the "easiest" route to get a Conviction - it is AMAZING how you really FEEL guilty until one proves one is innocent .... I was stood in the dock when the CPS Prosecutor told his assistant - 1m from me, that it was an "open and shut " case ... 24 hours later - having dispensed with my USELESS defence Barrister - he [Prosecutor] didn't seem to want to look in my direction when I was found Not guilty ( unanimously) on BOTH charges and awarded costs, etc., I remember being offered to Kop a plea - accept the Common Assault charge and the CPS would "drop" the ABH... I used to have a great deal of faith in the UK Judiciary, but the CPS seem to pay pean |

| mmmmm Sorry to hear of your experience, but glad the right decision prevailed in the end. As for Gerrard, I personally find it hard to believe that he would have done anything malicious. I do worry that the people who shout that he should be put down etc. are Man U supporters. As a neutral, I just hope that the correct verdict is reached, as in your case. |
