Please see my post re Land tax held by the developer a I am trying to find out the legal position as to whether it should be held in a sepoarate account from the company or can the developer use this tax money collected on behalf of government to line his own expansion or pockets. Thank you.

We have heard this week that quite a few people have been refused PTP, now obviously they will appeal, after appeal if it fails what happens then?? Who is responsible?? LEGALLY is the seller to refund the buyer, i.e. for not telling them it was near a military installation or for not paying the loans on the land etc? Legally is the Advokat responsible for not doing the correct land registry work or wrongly advising the buyer? Legally is the agent responsible at all?

Do those buyers have any Legal tools to get money restored to them?? Do they get refunded the duty they have already paid?? is the only way to resolve the issue to sell the house?? how does that work will the next buyer not get refused PTP?? What happens to the houses do they get seized?? Then what happens to them?? lot's of questions but I think there are some people out there in the light of recent events would like to hear the answers from a Local Law Firm.

Even with a clause do you think you would be protected? From what I have read contracts are worthless as the are unenforceable.

Pikie, please read messages 1 and 2, to me this implies that this is not a general discusion thread open for debate. The questions placed here are to be answered by a member of the legal profession who has kindly offered to give some answers.

This means that interested users can get some answers to some questions from the Horses Mouth so to speak instead of from the orrifice at the other end of the horse.

It would be good if Izzet had a page on Cyprus44 with the most up to date TRNC constitution, then the questions may start flooding in on international and EU laws.

Question for the lawyer please..A law was passed in TRNC Parliament in Oct/Nov 08 stating that foreigners could purchase land up to 5 donums as long as there was just one dwelling on the land. Apparently that law is still not in place as Talat hasn't signed it due to some objections.



What's likely to happen with this? Is it going to just be forgotten about now due to the elections coming up and a new government likely to be in place soon?

What are the responsibilities of the Lawyer/advocate in relation to:

- Checking out the builder at the commencement stage of purchase

- Translating Turkish documents into English/other languages

- Supplying documentation at commencement of transaction and not only when trouble starts

- Providing receipts to customers when monies are paid

- Ensuring monies which are paid through them on behalf of the client are only spent of the items stated ie electric transformers

- Duty of care to customers

- Extent of their responsibility to client ie appliation for purchase - title deed transfer (all inbetween???)

Interesting statement from that website (mess 18) "Under the Advocates Regulations, an advocate’s duty is to protect his or her client’s rights to the best of his capability".

Doesn't that conflict with the statement that an advocate has no duty of care to his/her client?

I think that TRNC advocates should hang their heads in shame. Every other profession or business owes a duty of care to provide the service you expect and pay for, yet not TRNC advocates it seems.
