I'm not worried until further details come out, there's a lot to unfold over this yet.



The problem for us at SWB will be how it affects the sales.

We don't want unsold properties or the place left as a building site.

Loby, I think you're right. None of us know how it may affect our ownership, only time will tell, but it is likely to discourage purchasers of the remaining units.



In practice, not only are there many overseas buyers of properties in NC, but there are also many settlers from mainland Turkey. I can't see how the clock can be turned back 35 years. It would be like Germany demanding a recount of WW2 in 1980 [or in 2001, questioning the decision of the Russian linesman].



I simply think we need to take a cpl Jones attitude to it; either "don't panic" or "they don't like it up 'em" - your choice.



IF it comes down to paying a reasonable amount of compensation [for what was after all unimproved land], I wouldn't be against it. But there should not be a gravy train for a GC to hold everyone to ransom.

Just had a message from C42 our other neighbours (1st Villa through gate) they had a great time and as this was their first visit to SWB or seeing the villa in the flesh they are really excited. They said they met Alex and Linda and a few people on site as well.



Loads of people working on our place yippee.



Mermaid are working hard as they have just measured up C42 and will be doing ours shortly.

Woo Hoo we are back in action. Am I the only one that suffered withdrawal symptons and missed you guys?

54 sleeps and we will be back out there. The photos we have had in the last few days of C41 are fab so we are even more excited than before. Have organised that our garden is to be gravelled so thats another thing crossed of the list and no worries with raging weeds when we are not there.

Next job is to get Mermaid to measure up the curtains and quote for the pergola coverings.

Arthur it would be nice wouldnt it but it sounds as if the woman is in a desperate state. Date raping for his credit cards atc , then possible salt mines then chinese spare parts lab where does she go next. I guess if she can she will keep us up to date. Anyway 35 days to go I think but the head is not very clear. I have emailed Naomi for advise (eg re how the NC property should be held whether in single joint or trust) no reply yet. On a complex with in xs of 130 dwellings as far as I am concerned the situation has not changed we always expected to pay compensation but certainly not lose the property. I do have the view that anyone, not just the purchaser who has profited from any land that did belong to a GC , should contribute to any compensation legally due. However Ltd Companies can disappear cant they ARthur with directors taking the dosh. I do not expect SWB to be a company with directors like this but I dont know who they are from Adam. Anyway did anybody or can anybody (cont)

even research the history of the land?. It would provide some comfort if the developer could post an official comment coz if the claim any claim is against SWB can they proceed to parcelisation? If NC just ignore the Oram thing I guess they can, lets hope the development is completed first and then take it one step at a time.

I agree with most of what you say Rocky, but I think you're optimistic re SWB contributing, or even whoever sold the land to SWB contributing. If I was advising SWB, I'd be telling them to get assets out of the company fast and leave it as a bare shell, so that any claim would be pointless. In any case, I think the Orams decision will rest on whoever is using the property/land.



If the Orams case shows anything, it's that reunification can't possibly go ahead unless there is an agreed formula to solve land disputes without restitution- it's not just overseas buyers, but also a lot of settlers from mainland Turkey. There is also the matter that difficulties for overseas property owners will devastate the NC economy. By inference, if reunification took place without a sensible deal, the damage to the NC [and thereby RoC] economy would be similar to the huge problems Germany faced on reunification.

Either a sensible deal is done on land compensation, or the NC government needs to take steps to make it's land registry secure. I think some search may help in finding out what we are dealing with.



However, on a more serious note, do you think Roy Keane can do the business for the Tractor Boys?? I suspect he's already written out his resignation, just needs to ink in the date.



Finally,[on an even more serious note], is Julie Christie Mrs Z ?? Was she one of your youthful fantasies?? Personally it was Jenny Agutter for me...................

mm not sure if anyone has raised anything with swb I seem to remember that someone said Yoav was going to post an update after K & M invited someone in for tea but have not seen anything.Perhaps now is an appropraite time but I dont think there is much anyone can say yet. Rocky, I have said many, many times to SWB that they need to get their act together on information, all to no avail. The Orams case is a significant issue, but there have been many occasions where there has been negative [and ill informed & deliberately negative] posts by certain persons which could have been stopped dead by SWB.



I can't see how Naomi or any other lawyer can give a meaningful response at present. really the whole thing needs to go through the legal process. If it follows through to the logical conclusion to the present decision, there will be hundreds [if not thousands] of very pissed off people.

I have a reply from Naomi see below .but as I said....there is really no answer yet!!



In relation to the case of Apostolides v Orams (the ‘Orams Case’), at this stage, we can only state that the preliminary ruling by the ECJ is an opinion of the ECJ on the substantive points of EU Law raised in the case and that the matter will now be referred back to the Court of Appeal which will make a decision on whether or not to enforce the judgment issued by the Court in the South of Cyprus. Until a decision is reached by the Court of Appeal, there cannot be a definitive answer.



At this time, we can only rely on the information provided by the TRNC authorities as guidance. We would recommend following the link below for further information on the status of the case.

A belated thankyou for the photos on snapfish of 120 and I believe your daughter posing in front of the patio/balcony. I'm sure you see our point about needing a ballustrade around.



I see a few people are going out in the coming weeks, we'd be really grateful for any update photos of 120/1 (if you are stood on the road that runs past the sports courts looking towards the building it is the left hand side one (slighly lower balcony) it should now have a ballustrade on.



Rocky, my advice if you hand over via RMS make sure you hold back a good snagging payment, as they don't seem to get the snagging done very promptly. We completed supposedly in Feb and are still waiting for the final bits to be done and answers on some of the snagging issues, although admittedly we aren't pushing them as it seems more important that they get on with completing as much of the major building work as possible.

sheila this judgement or what ever it is as destroyed the norths property market over night thats for sure, sweetwaterbay will not sell out for or if for the long term , that in its self is very worrying. before this judgement i put it to edith about the site being sold out and she said to my amazement that for every three sales they had four cancelations! due to the echonomic situation. with this ECJ and the credit crunch its looking bad. im trying to be positive but ive all but emptied our life savings into this and i cant not be very concerned. .

Andy dont worry..you die if you do and you die if you dont....this is purely a judgement that will probably and possibly be overturned by other events in due course..think of the precious things in your life your wife and your daughter the Zorbas cant take them away...the property thing will sort itself out with some sort of compensation which we always understood would be forthcoming...then the properties (if finished) will boom in the next economic upturn - stay positive and my forecast in Feb for the champions league final was Barcelona v Arsenal and that still stands......well for 24 hours anyway

andy u should be happy at the moment with Man U, but shame theres no news from Mrs Z if the foot fits the clog the case could still be open so dont worry about Z untul we hear something for definite. SWB are disappointing there is no official statement from them I thought that would be essential in the current climate not sure if we are protected by the compensation fund or not any one have any knowledge on this or is it once again head in the sand time. Rocky, I appreciate it doesn't look good, but I don't think there is any realistic choice but to stick with it. It's academic for us because we've paid the full price, I guess you have to make a value judgement. All I would say is that if the Orams thing is seen through to conclusion on the existing decision, I think it will be the worst possible thing for NC and even the whole of Cyprus. With the Annan Plan, compensation would have been paid for those who lost land- not restitution but the next best thing. Apart from our own [perhaps selfish] interest, I don't think the GCs have really thought it through. Will they be welcome in/want to return to the North? Unless they have skins like rhinoceri, I doubt it. If they take back their land [and by definition expel Turkish settlers and expat owners], I think NC will be an economic wasteland. As this scenario would really only happen if Turkey abandons NC [and thereby NC would be part of a reunified Cyprus], is that what GCs want??

Arthur I think cash will talk in the end with various farmers walking away with dosh tied to their goats and sheep perhaps not unfair in itself but why should the landowners post 63 and 74 conflicts in Cyprus be any different to the landowners in previous conflicts across the world. The concerns are will swb take your advice of a previous posting, will parcelisation ever occur? will the development be finsihed? and and and!!! I know they wont but developers could calm the situation by making clear the position and their own position on this and how they can help their customers. Declaring their own financial status may provide some confidence! Silence is more concerning. I see Naomi has info on her website but it does confirm she cannot give an opinion she confirmed this already in an email to me? a little different from here in the UK where advisers are accountable and if they get it wrong we can obtain redress through the professional indemnity insurance

I have now listened to a number of views from differing sources including Naomi and SWB and although no one can give specific advice the following is relevant:- It does appear that nothing has actually changed during the past years (with this prolonged case offering rulings to both sides).This case eventually will be called before the London Court of Appeal and that ruling should be the final one. The Orams did not even attend this case as they knew the ruling would go against them. SWB is a large development, not a single plot, making it a different scenario. SWB is built on Exchange land title thus the TRNC government’s responsibility in a way (as well as being differentiated in the U.N Annan Plan of 2004).as we all know the TRNC has of course instated a property claims commission, financed by Turkey. This body can and already has awarded compensation for lands abandoned in NC. It is very probable the SWB land may be settled in that manner if there is a valid claim.

SWb of course cannot give a definitive answer because there isnt one but it is unlikely anyone will take individual actions against 130 worldwide owners but I do expect we will have to pay something at sometime hopefully not too much though. After any compensation is paid and the property market picks up then all should be ok Andy.

I really can't get too excited over the Orams case.

Whatever happens it is way down the line and I am now about to make my last payment, minus a couple of K for the snagging, so I am committed.



I have had furniture delivered and more on the way, I shall go out there enjoy the site the surroundings and I'm sure the company of the other owners and just let things work themselves out.

Constantly worrying about it won't help and expressing your worst fears and anxieties on the forum will only make certain people very very happy.



Think positive, the worst case scenario could see all the SWB property owners paying a small sum in compensation.

I am just about to pay my fourth instalment, but have not been given a date for the completion and final paymeny yet.

How does it work? I am going to go out once I get a date and do my own snagging, do you hold the whole payment back or just a percentage of it?

Also, where did you get yor furniture from if you dont mind me asking? I was thinking of going for some kind of package deal.

Any tips or advice at this stage would be most appriciated, like the process for connecting the Water/Electric etc.

Kell - many people are holding back around £2,000. as per contract - we instructed a Stuart Hillard (surveyor - check out his website - he is based in NC) to do the snagging for us. We purchased our furniture from 'Electrokur' in Girne and our beds from 'Mermaid' - in relation to water/electric - the lovely Connie at RMS will organise this for you - just send her an e-mail. well if we hadnt had enough of north cyprus last month we are back for more end of july. just paid £1107 for the three of us monarch to larnacre. its susan and mine anniversary (25th) on the fourth of august so thought id spoil her and take her to the nicest place on earth. you never know we might be able to complete while we are threre. .

Hi I am here. Phil posted the other day but he was royally ignored 49 sleeps for us before we can be there. So we will miss Rocky by 5 days after we leave in July and Andy by 8 days before we arrive again in August. Its a bit nerve racking not knowing where we will be staying though espcially with 3 large teens in tow in August!!!!! But with still 2 stage payments to go and no photos on the ste since 19th Jan we are trying not to count our chickens. We have had photos from others and we are well on the way as it looks like electrics are nearly done some of the sanitary ware is in the tiling looks complete so next stage payment cant be far away.

Don't know who had C51 hope they didnt have to pull out due to credit crunch and lose money. I dont think the Orams case will make people pull out though. Well done Andy on your 25 years.

reply 67 sheila I am booked to go to NC on 7th June from stansted with Pegasus, never used them before, should complete that week. Curtains, blinds and main furniture all should be deliverd 9th June...back on 12th June. Then I think we as a family (leaving the lady friends behind) go out for 9 days in July, after that I will probably allow a few friends nd family to use it cant be bothered to get into renatls and tax over there and I am not sure that the rental market is not very active, mature or even worth it.

We're the same Rocky - our house in NC will be our second home - we will allow some friends/family to stay and that's about it. We've furnished the place quite expensively and will be worried about damage - you're right I believe the rental market is dead in any event. Pegasus airline is a bit like going to back to the 1970's - take your own food and drink with you. Some new photos of the site would be great!!!!!

No news for us re completion Rocky but ever hopeful. We still have the last 2 stage payments to go although from latest photos people have sent us we know we must be nearly ready to pay one of them. Who know's work may have really cracked on and we may just have to pay them both at the same time. We will be there 26th June and it would be fantastic to be able to get things sorted. Leaving the snagging, electric meter connection and garden to RMS to sort so thats a little less to worry about.

We met the buyers of C51 when we were out there once, they were a nice well spoken youngish couple with small children.

They had actually ugraded, from an apartment I think, so to pull out now with all the extras they've put in is a real shame.

The reductions in price are also a shame because it means my profits are not going up but I'm in it for the long term so eh oh.

Last time I was over I lost my camera somewhere around Buffavento castle so I bought a new one yesterday, I'd better keep a better eye on it.

I've been told by my wife and daughter that when I'm out there at the end of June I can't take any clothes with me just tools and household goods in the suitcase.

I think it's par for the course. Properties need to be sold so that the site is running at capacity. It's no good having plots unbuilt but even worse to have them built but unsold plus no money coming in either for communal stuff. No different than the UK so many discounted properties now due to the falling house sale market.

Loby- you don't need to take tools. Andy[SWB] will lend you drills, hammers, screwdrivers etc. He has a number of screws and rawlplugs, but asks for people to bring over these things so that there is a "pool" of fixings for people to use.



Anyway, if you ever have a need for a spare pair of hands, I'm sure Joanna Lumley could help [if Julia Roberts is busy with Rocky]

Seriously I'm also of an age where I get goose pimples for what the Gurkha's have done for this Country and to refuse them rights to live here whilst allowing people who hate us to live here is beyond belief.

Arthur, thanks for the info about the tools and the last thing I want when I come out is to be working on the apartment, I get enough of that on my English home but I will bring some spare things out and donate to the pool any extras.

About the MP's expenses it's just a disgrace. Any MP of all parties who has taken the 'p***' with their expenses should be prosecuted and voted out next election.

I know if I'd been found out doing this with mine I would have been sacked.

Hi All.

Finally got my keys to villa - on the same day went to Kibtec with copy stamped contract plus registration docs (all provided by solicitor - Naomi Mehmet) and paid 279 ytl deposit plus 71.91 ytl meter fee and 150 ytl to credit my account so I dont have to worry for a while... it was completely painless (even with a short power cut during which I was offered coffee/tea/water whilst I waited for reconnection). Had to call into payment office first to register application then given a set of papers to go 'next door' where a really lovely man completed the paperwork, after which sent back to first office to pay the monies. Got an email from Arthur B18 last week to say the meter's in and he's kindly taking care of my fuse. All in all, a very easy process taking just two weeks from payment to meter at only a fraction of the cost I had been expecting... xxx Just hope my furniture shipment goes as easy. xx

Hi there is little activity on this thread now so lets get it going again. Mine has been snagged and yes there is a list of matters for swb to sort but I did not retain the full amount allowable as realistically they could be sorted quite quickly!!!!!!!!!!I also asked naomi for the fatura re VAT but that cannot be issued until you have paid the full amount. SO the main areas were redecorate lounge, fit white goods and straighten some sockets and switches I guess this is pretty common. R u ok andy u haf been kwyet ofl8 f u sent ne mor £ and arfa u r motionless,

First time I've noticed this but on the SWB website, the Google earth link has been updated.

It's not bang up to date but you can see the swimming pools, apartments, layout etc.

It's good to see the site in from the air and the old road leading to our site (btw needs a top layer of new tarmac)

Out Sunday 28th June for a week with my daughter, will arrive very late I think, going via Istabul with 2.5 hour stop over from Birmingham.

Doesn't sound like it's going to be much of a holiday for me though, the females of the family have got tons of jobs for me to do. I'll find time though for rest and recuperation with a few beers thrown in.

There's a few others out there at that time so that should be nice.

I'm need to stay in somewhere inexpensive for Sunday and Monday night and I noticed you were advised the Fez, so may give that a try.

Loby we arrive on the 26th not sure where we are staying yet though.

The neighbours in C40 are flying from Birmingham and are arriving also on the 28th so you may be on the same flight they are staying at Sammys Hotel which they highly recommend.

Jakki, yes the man is doing our garden can't abide the thought of having to weed in the heat!!



Hopefully Mermaid have been along and measured us up as we picked our fabrics out last time we were over. We want them to quote for the pergolas to be woven as well. Have you got both yours done or just the back one?

Your right rocky, I seem to be on here all the time at the moment, though I'm more looking than posting.

I think we've probably got quite a few SWB'ers who are doing the same.



Sheila, I've provisionally booked the Fez but strangely enough Sammy's was going to be my second choice.

Mermaid should be putting our curtains up on Tuesday.



Your neighbours in C40 have you contact details for them ?

If they are on my flight we may be able to share transport/costs at the Ercan end ?



Arthur, just a thought, in the summer it's baking hot and cars left out tend to get too hot to touch, rocky will probably tell you how he used to boil eggs on his tank in the war, so it may not be such a bad idea getting the carport done.

For us Loby the car will be a rental for the next few years so we will do the usual covering the windows etc and putting towels on the seats and probably get the side pergola done when we move over permanately.



I will find out which flight C40 are on and how they are travelling to Sammys for you.



Maybe if Mermaid are there on Tuesday they may do our measure up at the same time



One thing we need to check out is getting a log burner for the winter fitted in the sitting room.

Arfa what happened to your restuarant guide? can you remind me the restuarants very close to SWB that you recommended. I think some are to be avoided.Someone else must have recommended one in Tatlisu old village was it you? I tried Steves Bar last time was adequately looked after but I prefer local food restuarants I had a great lamb dish ( Cant remember the proper name but know it as Thieves Kebab)on the terrace at Bellapais in November.

We haven't eaten in Tatilsu village - but Arthur's Good Food Guide (thread) should still be available (look under Sweetwater Bay) - We also tried Steve's bar (very British) - too smokey for us and the food was OK (I bet others who read this will tell me off) - we also prefer local - but must recommend The Moulos Inn - great Italian food - just like mamma makes - very good.

the last person to try a swb residents assc was keith hunt , if this is keith why would he post under a name "nimrod" which by the way was britains biggest aviation disaster! not what i call an inspired move, cost thetax payer in the seventies hundreds of millions of pounds trying to build our own early warning aircraft, after many years trying to make it work it was scapped by mrs T and we ended up buying four boeing AWACs of the US. . Andy I did not know you were an expert on aviation history I was very impressed. Perhaps if it is Keith he may be doing it with good intentions after all he and Moira have been there a little while and are getting to know their way around. I request that whoever Nimrod is that he/she (even you Rasputin) should email us declaring his/her identity then I would be keen to join. Presumably its not Davina again is surely she hasnt time doing all the washing and shopping. They say women can multitask but it appears that only Jacki and Sheila contribute on a regular basis the others are doing the chores or attending school meetings, bingo halls and coffee mornings. I guess you keep your wife in her place dont you Loby?

Well, apart from putting up the new curtains in our bedroom, fitting bathroom shelf, toothbrush holder and soap dish in both bathrooms, fitting three wall lights, ceiling light for lounge, and finally shoving a broom up my #rse so I can sweep up at the same time as well, I think it's fair to say I will have a relaxing trip to the villa!!!

I have just heard from Edith who advises that it's not going to be a party but she is inviting clients and estate agents over to see what SWB is about. A local magazine is also going along to take picutures. Tt's really about promoting sales and 'people been invited will be there by appointment'. She says that the official opening will hopefully be in August. She is organzing sun loungers etc. to go around the pool.

going next week to the trnc consulate in holborn, london to get my poa forms sign so rainbow can apply for my elecricity meter. ive been reading that when you order things like furniture out there, they deliver it same or next day, how true do you think that is??

sam I have ordered curtains on the phone through Mermaid they can have them ready within a couple of weeks but they need to book a fitter who may take longer to organise. I have ordered furntiture over the internet thro Homeefront and they need two weeks notice of course you can buy stuff if its available in the showroom or store but may not be the fabric you require.it could be delivered same or next day.

Sam it seems you can get most things furniture wise quite quickly and even if you want different fabrics it only takes a couple of weeks. Loads of places out there make furniture to order.

Mermaid have been and measured up for me at the villa for all blinds and curtains and are making things ready for when I get the go ahead. They are also doing the canvas weaving on the pergola to give some shade at the back.

My garden is I think completed now and Connie is doing the electric for me to save me some time.

I have been out yet again buying stuff to bring over with me in the suitcases!!!!!

I can confirm that my experience is that if a TC shop says they will deliver on a given day, it will happen. Also, if something delivered has to be brought in, they will do it [and politely refuse your assistance], put the thing together if it needs assembling, and will take away the packaging............err, just like in the UK.

First time I've been at the top.



Rocky, I agree with Arthur, if it's the courts your looking for it's just before the big car park going into Girne. You can't miss it, plenty of street parking.



There's new photos on the SWB website, mainly of the sea facing apartments, wish they would update mine , no new pics. since 15/12/08.



If you look at the office building you can see the 'villa' at the entrance coming on as well.

I've not heard of Sweetwater view before but I hope he's not confusing it with Sweetwater Bay.



Whatever individual problems people have had, you have to admit the site is looking really good now and I can't wait to see the progress made.

Arthur and I think that the site should be completed by August - Andy we don't think you should have any problems with moving in during your next stay - that's just our opinion of course but things are looking good at the moment.

millzer it is probably too early to assess the problem of non payers you get this problem all over the world and in many palces there isnt a lot you can do about it. Can the management company turn off the water? Can we name and shame the owners?, do we paint a red dot on their property and throw tomaotes at them also we will have problems with non owners& non residents using the facilities whats the use of electic gates when often they will be left open?? in the usa people taligate to get into locked complexes anyway the perimiter walls will not stop people geting in.

Looking from the front, we have a double in the right hand bedroom, and a single in the left hand. i suspect youwould get a double in the left hand bedroom, but I think it would be a bit tight.

I was wondering about the sauna and jacuzzi they dont seeem to get a mention either. Connie said in an mail that the pool is getting used, I think we forget there are more than just us that talk on here and each week different apartments and villas are occupied or people are getting furniture etc sorted.

Its half term this week so maybe there are a few over there.

Sheila, I forwarded the shower screen photos for both our bathrooms to Jackie, so she should be able to forward them to you. She also forgot that I did use the gym [it was a way of relaxing from the list of work given to me for things to assemble/put up/fix in the villa]. If Phil is looking forlorn and at a loose end when you come over, I'm sure that Jackie can suggest a list of "things to do around the villa"

In C41 we have a bath downstairs and a wet room upstairs.

We have already had a shower screen put in downstairs over the bath but when talking to Jakki and Arthur they have also gone for a full length screen upstairs in the wet room as the water ends up everywhere.

So Jackie sent me the pics of it and it looks good so I am about to email connie to arrange for one to be fitted the same.

spoke with edith today who said our appartment will be ready end of june. she was in good spirits and said we will have our own supermarket and bar, shes at present sorting the pool area furniture out . she as also purchased some real palm trees for this area! i have today sent a e-mail to sarah verde of homemakers for a quote on snagging and hand over etc ( ken and ronnie used her and said shes brill) as anyone els used her? also edith said a new K-PET stastion is being built close by

hope every one is well...... i went to the trnc consalate in westend london today, took about half hour to get my forms stamped.... in some basement room with 4 chairs and about 25 people waiting on a hot day, nice!! anyway its done now, got to send that to connie and nmp legal so rms can apply for my electric meter while im here... bet its lovely out there now, the pics show its really coming along nicely.... another question, sorry ha ha..... does anyone have measurements for the windows and patio doors for the one bedrom apartments??? not sure how much curtains cost but im sure i could save a few quid buying the curtains myself over the quotes ive had so far. . . ive also had to resit an exam now so im thinking my trip might have to be pushed back to the end of june, not 100% but i think im just going to have to book a late deal.Rocky with re to non payers i like the tomato throwin n red paint, haha!!!

hi steve, yes its a petrol station. i can only state what she told me and she said we will have our own supermarket and the bar resturaunt is being looked at by a number of interested parties to buy it, this does go against what mike armstrong told me in april Qoute: "no one will touch it with a barge pole" edith also told us in april about a big extravigant opening party with a band etc on mid summers day! and this turned out not to be the case

coming over on 13th August CANNOT wait as staying in the apartment, expecting trials and tribulations but dont care. Theres 5 of us in our family with 5 big suitcases, everying from 23' TV to bed linen to Irons and kettles. booked in satterlite intallation, wall lights being put up and property to be secured and plenty of shopping all in the first week then hopefully 2nd week relaxing.



Andy- resigning to fact that possibly wont see the bar/restaurant/supermarket facilities opening till development showing more signs of life. It would take a brave person to open up a business in this climate on a brand new development IMO

What type of satellite are you getting. As we will only be there a few weeks a year not sure if its worth it?
