The last paragraph, a statement from the Plaintifs lawyer is very interesting.

How can Mr A's lawyer doubt that it will lead the way for thousands of similar claims? What was the political point of the case then?

The cost and the time,

how many GC's have a few hundred grand for legal costs up front remember legal costs are awarded retrospectively.

Also he knows the work he has had to do and the costs, he is probably the most qualified person to make that comment.

The point is a GC has won a minor battle over land in the TRNC it is all about face. Greek Cypriot Pride.

and that pride may have just divided the island for good.

I have just read the article on judgement, if the plaintiff has succeeded based on the fact that Cyprus is one and all part of the EU and everyone is subject to those rules, does it not folow that the same application applies to say land lost at Larnaca such as the airport and electric company sites etc.

So, if the TRNC Government were prepared to assist, all those owners of Es Deger land who are resident in the EU could be provided with the deeds to their "exchange" land in the South. They could then take their claim to the RoC government for back rent and return of the land/property. And as we are all one big happy EU family resumably the ECJ would force the RoC government to comply.

Interestingly enough it is a far tougher challenge the other way round because information on who "owns" what in the TRNC is held by the TRNC government. Also and more fundamentally, restitution of the land property is a real possibility in the South under EU law whereas, whereas return of land in the TRNC is outside EU jurisdiction.

Hang on. I've had an even better idea. Rather than demand the land back in South Cyprus they could offer to sell it to the present owner. Then they could take the money from the sale, find the GC owner of their Es Deger plot in the north and offer to buy it off him/her. Might even make a bit of profit!

But I guess it could get a bit complicated if the land in South Cyprus had been built on by the current user, or if the land was used by several GC's (or of couse if someone didn't want to buy or sell ..). What they could really do with is a formula/plan to work through all these sorts of issues, especially if it starts happening on a widespread basis. Something that addressed the rights of current users and dispossessed owners in a fair and reasonable way, managing all the complexities without favouring one side or the other.

But wait, didn't some people spend a bit of time thinking about this a few years ago. I seem to remember that Kofi Annan had some involvement . . .

I love the brits, so much fighting spirit. There is a much publicised court case going on and they are still buying in the TRNC. Thats why they get on with the TCs cos we have been fighting all our lives. We have been living unrecognised for over 35 years with no financial help from anyone but Turkey and we have managed very well. We have roads, hotels, some tourists lots of banks a government and loads of restaurants. I dont think we have done too bad compared to the greeks.

If anyone thinks that the Orams case is going to make a difference think again, the Loizidou case was won and has changed nothing.
