This throws up some very important details that I did not realise were relevant, is is certainly very important that EVERYONE fills in this form HONESTLY whether their sale went through smoothly or not, so that an accurate assessment of what has and has not been done can be made - just click on greenman's message 3 and it is very easy

Yes, we have.

I gave our solicitor 1 out of ten and that was being positive I think.

He paid all our money over to the builder for our completed villa without checking out the title on the land.

Guess what?, yes you guessed right there is a impediment on the land.

There are others on our site who are also affected.

How do they get away with it.

The builder signed our contracted warranting that there was no impediments, encumbrances, charges or injunctions.

People need to be aware of the solicitors and builders involved in the above scams. One of the biggest problems is that people rarely identify them. This then leads the door open for others to be ripped off too. I have always been concerned about the number of people that recommend their solicitor well before they have completed and received their title deeds. Problems don't usually surface until very late in the process when the builder and solicitor have got nearly all the money.Having mistaken hospitality for honesty, people then recommend their solicitor, only to find out 1 year later he was not as honest as they had thought. If the HBPG can help buyers avoid these so called professionals then this is a real benefit, so please complete their information forms.

Couldn't answer all questions because villa not complete yet. Also stamp duty still not registered, so can't be sure of mortgage on land etc. Will complete after end of March when more info should be available.

All purchasers should now be fully aware of the pitfalls and should not sign for any home till all of the things on the HBPG form have been given a tick of approval, anyone going ahead without all the proper procedures being in place have only themselves to blame, because the glib tongued sales people (a lot english) will still be able to get them to sign on the dotted line regardless, I along with many others only wish these guidelines were as readily available when I purchased, but in saying that my problems were miniscule compared with a lot of peoples, and my builder was "reasonably" straight

Turtle, I completely agree with you. I was totally deceived by my solicitor, when after 3 years my breach of contract case finally came to court. Whilst givinng my testimony I was instructed to hand to the court the original contract of sale and also all receipts covering payments. As soon as this was done the judge ordered an adjournment to his chambers. I was told to stay on the stand and everybody else left the court . After 15 minutes my solicitor came back and told me to wait for him in the corridor. When he came out with the rest all smiling , he told me that we had won the case and had been awarded the return of our money plus 3 years interest, but that he was in a hurry but would email me a transcript of the judgement. Although I have tried to contact him many times over the past 3 months I have never heard from him. I would like to name him so that others may not allow him to do the same to them.

looked at the lawyers questionaire but it seems to apply to off plan builds. As we didn't buy off plan but a new build. Most of the questions were not relevent

to us.

i have no intention on filling it out as yet until I understand what there is to be gained out of it. Can anyone tell me? I have been content with my solicitors performance to date in fact for th elast few months they have responded swiftly and accurately to all queries and corespondence by myself. Is it not simply a case of 'getting for what you pay' I ask

most of it is also irrelavant if you purchased an older property.

its great for looking at the new constructions but useless to gain a judgement of lawyers.
