Yet another scam which I'm sure isn't new, our vendor wants us to pay thier capital gains tax if we want our Kocan, and as per usual we have been "advised" to pay it as the legal system cannot force the vendor to pay it even though it is their obligation. No Pay No Kocan, its not really No Win No fee is it. We have done the usual over the last year or so registered with the PCO and HBPG......... when will this nightmare end.

how much is he asking you to pay.



it should only be 3% of the buyers price. He will have to pay 6% pressuming he has land under his name already. You should really speak to him or get advice from another solicitor. This is not right, keep on it.

Can l ask who the construction is?

Hi Girne, we have supposedly one of the top advocates, who to be fair has said we can go to court over this, but unlikely we would get any compensation. As for the builder they only have one project "Monarch" we did buy through again one the biggest estate agents. Its just annoying that the government will not issue the Kocan to us, even though we have done everything by the book and on time, as its a government tax they should chase the vendor just like the inland revenue would in UK. I'm sure if we owed any tax to the TRNC government they would soon be on our case.



"Over a barrel" come's to mind, and rip off the brits as we are obviusly loaded (after all I am printing the money in my spare room of course)

who is this "Monarch"? I am familiar with most builders in the TRNC, but have never heard of this one. Do the individuals of the company have names? Where do they advertise? We have to collectively campaign against these toe rags, if only to protect our fellow countrymen.

Better to have fought and lost, than never to have fought at all, is generally the case but we have to make a stand.

Why not wait until the Oram's case is finally ruled upon? While the builder has the Kocan, he should also be liable for any GC compensation - consider the ramifications!

Evergreen are demanding 4% for their portion and .75% for our portion.

I shall be starting legal action when I go out in 4 weeks.

thats my advice ,let all the greedy builders have the kocan and let them deal with the problem .



aint worth jack anyway....trouble is theyre all on the take and think we are their cash cows ,let them deal with the issue ,let them be exposed one by one and lets a few done for blackmail and extortion .

our vendor tried to get us to pay their capital gains tax, the kochan/tax office caught them, called everyone back to the office to sort it out. they did have to pay!

this was about 2 years ago now, so things may have changed but the office for payments are very honest and won't have any funny business, so it might be worth speaking to them for some advice.

Once again there is this perpetrated fear of going to court to get your rights upheld. I don't understand why this is. At times I feel that the contrbutors to threads like this are all in league with the rogue builders!



How many people out there have actually been into the courtroom and lost? own up ? That is, as opposed to those who repeat 3 rd hand disinformation?



I went to court when the builder demanded (funnily enough in proportion) the exact same sum, and from experience can assure you, that once in front of a judge, if it aint in the contract, then it aint going to get paid.

And at the same time you can get everything else sorted out.

my experience was nothing to do with rogue builders it was with a private seller.

a nice expat lady who tried with the help of her lawyer to have us over.

unlucky for her the trnc goverment office spotted it and made her pay!

In Reply to who has taken court action, one owner on our site has, and they won their case, but the builder still hasn't paid the compo as supposedly hasn't got any money, I am very interested in the comment from "fire starter" in message 10. will certainly try to ask when next there. Also I am in two minds if its worth actually getting the paperwork just in case the land thing falls around our ears I won't be left holding the baby at that time will I?

Hi Firestarter how did you manage to get the TRNC gov to force her to pay, as we would be interested as our advocate is suggesting if we want our Kocan we will have to pay even though the builder is supposed to. Our only option is to take them to court (cost to us)and if the decision goes our way, if builder says they have no money and won't pay we still don't get the Kocan until it is paid by someone....... not much of a choice is it?

Hi witchfinder - maybe it was because firestarter's vendor was an ex-pat, an easier target than a TC builder?
