| hi shiela , his name is john and he trades as "the flyman" we where put onto him by friends at turtle bay who used him. we have had all three bedrooms ( one of each window) one in our kitchen and the patio door . the total cost was £440 . andy |

| that seems a fair price Andy..did he match up the colour for the frames to the existing windows? also I have found a supplier for a timeswitch to replace the on/off immersion switch. I got the website from Mike. The switch is not a like a central heating timer but a simple selection of buttons to push for 15, 30 and 45 mins I think. They are about £23 each and of course prevents the immersion from being left on. If anyone is going over at christmas why not fit one of course fit one for me as well. It is the same size as the switch and just replaces it. |

| Andy I guess if M had not have been diligent getting them to clear the drain holes and checking that they had fitted the right windows you may have referred to them as cowboys. See how many are left at christmas if there are none left you may still refer to them as cowboys. If you have tried the cowboys next time use Patel & Patel and then you will have tried the Indians. Did you think about the immersion timer? If so do you want the web address if I can find it? |

| According to this thread: http://www.cyprus44.com/forums/26554.asp Sweetwater bay took their customers to court to try and silence them because they opposed them managing the site. If this is the case, why are they being given an award? Last year Seaterra won several awards and yet they mortgaged their Reserve site for £2million (still unpaid) breaching contracts in the process. I'm surprised Gary Robb hasn't been awarded one for selling the cheapest properties. These awards are not voted for by the public or customers and entrants enter themselves and pay a fee. There are many good developers here, but I would suggest the Property Awards panel who judges this does a bit more research before they give out these awards because it will become farsical. |

| Its incredibly difficult to join something that you cant get a straight answer about I agree!!! An owners association that is only being promoted to a small number of owners and with the suggested founder members having the track record they do doesnt give me a good feeling going forward..... |

| SWB are going to pay the RMS monthly fees for all unsold units and this association are promoting that SWB will not have a say as fee payers. This then potentially means the shortfall will be down to the rest of us. So at present approx 40 units still unsold that possibly SWB will now not pay for if this association goes ahead. If SWB dont have a say and dont pay then that leaves approx 100 of us unit owners to pick up that shortfall!!!! Figures are as I say approx but thats approx £200 - £250 per year extra each . |

| An owners association should be working for ALL owners and WITH the management company not one that has been setup by a small group of residents that have waged a public campaign against RMS and SWB SWB have said in their last email ... It is in the full interest of SWB that such an association is formed, that it represents ALL unit owners and operates transparently and efficiently in collaboration with the relevant parties & authorities. SWB does not regard the relationship between residents and developer as an "Us and Them", as regretfully evident from the recent attempt of formation (in which an absurd and illegal attempt is made, to revoke the representation right from legal owners of all unsold units, i.e. SWB from representation in the association). We believe the association can (and should) be formed in cooperation of all parties, for the benefit of everyone. Personal invitations to join the formal SWB residents association will be sent individually shortly. |

| I have to say that SWB/RMS need to get their act together, otherwise people will see SWBOA as the only option. What is disappointing about SWBOA is, despite several attempts by both others and myself to get a straight answer to "who are the subscribers" we simply don't get an answer. However, I think I'd put rather a lot of money on being able to guess the British owners who are subscribers. More importantly, the M&As as drafted by SWBOA specifically exclude SWB from having any vote or representation, despite the fact that they still own about 30% of the units. When I put the question as to whether SWBOA wanted to give SWB a valid reason to not pay their service charges [because they wouldn't be able to vote], the only answer I got was "that will be for the committee to decide". Actually the answer should have been " we'll amend the M&As". I'm afraid I have no confidence that SWBOA won't be a vehicle run by and for the nucleus of permanent residents. |

| How much are your monthly fees on SWB? If as you say there are 40 unsold units left and as a guess if your man' fees are £50 per month per apt then that is £24,000 per year that SWB are saying they will pay for the vacant units. It would seem that your SWBOA are giving SWB the perfect opt out excuse not to pay so maybe that is a mistake. Personally I know of no other developer that has/is paying maintenance fees for unsold units and if SWB do pay, then quite frankly I will be amazed but hey, there's always a first time. |

| Andy, in reply to you and following my msg 25, to clarify, RMS aren't involved in setting up an association, this is entirely down to SWB. I have to say that at present, apart from getting an e-mail from Marieta, despite e-mailing Yoav over two weeks ago, I have heard nothing from SWB. It is precisely this lack of contact or reply that gives SWBOA oxygen. We really need Yoav/Edith/Andy to get a grip of this, keep people informed of what is, and what is not happening, and resolve the building problems outlined by Sheila in msg 27. Also, forming a truly representative association is a top priority- this has been mooted for about four weeks, and yet we have seen no substantive progress. |

| well edith rang me monday morning last week but it was to tell me about the awards sweetwater had won at the rocks , if i had had the e-mail before i would have asked the relevent questions. seeing we and sheila are over at xmas seems we should have a face to face with them to see whats happening , it does no favours to RMS/ SWEETWATER when they ignore owners e-mails but how many times have we complained about this! |

| Hi everyone I must confess I am on the fence at the moment re the RA's. I find it difficult to believe that a property developer like SWB will be the first developer to pay maintainance fees.I cannot understand why they would elect to pay fees at this difficult time for developers. I also dont believe they or anyone else should hold a block vote. Any proxy system should be very limited so that no group or individual gets individual control. It is clear that commuications have been poor from SWB and at times from RMS hopefully any RA will have improved communication systems. Even if SWB do facilitate an RA they would have no control witout the block vote. I know some are reluctant to support the RA which has been set up but surely these owners have the same interests in their investments as others do. Yes they appear to have been anti SWB and I can understand some of these frustrations. Regarding RMS I feel we should give them time to prove themselves. A question how many RAs can we av |

| Rocky- I share your scepticism, but hope I am correct in the assurances I have been given about SWB paying their service charges. I personally don't give a damn about a "block vote", if they own 30% they should have 30% of the votes, in my opinion there is no other way. If you owned two properties, I'm sure you would expect to be entitled to two votes, and so on. I have to say I'm very frustrated at the promised new association which we're still waiting for- another case of SWB shooting itself in the foot due to the lack of communication. |

| Arthur there are risks if anyone ,albeit SWB or a group of people hold a substantial vote through ownership or proxy . A small number of people or SWB can then take control , believe me I have been in this situation. This goes against what we are all saying including you that all types of owners must be represented. Yes they would be represented but if they provide a proxy the individual(s) do(es) the voting! On a sporting front you must have noticed Ipswich moving towards the play offs. |

| Rocky, I have sympathy with what you say, but it doesn't seem fair to prevent 30% of the owners having 30% of the votes. What I am looking to achieve is a committee structured in line with ownership, i.e. if permanent residents account for 10% of owners, if there is a committee of ten, one resident sits on the committee, if SWB own 30% they have three committee members, if holiday home owners account for 40% they have four committee members and so on. I would hope that any danger of SWB monopolising things would be prevented by this, and I assume their contribution to the committee would reduce as they gradually sell properties. One of the dangers of the proposals of SWBOA is that this will not be enshrined in the M&As. I am fairly certain that most, if not all, the subscribers [who are permanent residents] will put themselves up for election, and many owners will know nothing other than names, and we will end up with a committee disproportionately representing "the permies". | spoke with mike today , the bay inn will be up and running in days . its got an outside covered area which he says will be ready for xmas. also told me its a resteraunt from spring time so that cant be bad can it. should be great over xmas as there are loads on site he said , also told me the mini market will be up and running for summer so another plus point |

Message 56... Andy I personally think the bar is a great facility but I was never in favour of the location. For financial reasons SWB needs to be an open site with the related security issues. My view was that any facility for the general public should be roadisde meaning outsiders did not have access to all the facilities. Once they are in how can they be challenged as outsiders when they may be tenants. |

She has a few cases against other developers as well. I would consider as having an interest if I bought anything from them or if I tendered for anything within their scope. | Rocky, You can rest assured that I will not share any confidential information with anybody unless I have the clear approval of the parties. As with this particular case, it was the Developer involved who referred to the litigation in mass e.mails in an attempt to frighten everybody who opposed their ways. My effort was to redress the balance. Even so I did not mention any names. Let us give it a rest but I will continue to update the relevant thread as to its outcome as a lesson to those who try to misuse the legal options. ismet |

| re the bar . . anyone who is against non owners or residents using it is living in cloud cuckoo land if they think they can force this, look at the korenium golf club its a members club with a twenty four hour manned gate, if you or anyone wants a drink or bite to eat you drive to the gate and he lets you in! this is northern cyprus every buisiness needs passing trade , cant believe its even being mentioned. good luck mike and see you in your posh bar in a week or so andy |

| I have emailed Mike with our concerns - basically the general public using the facilities (pool, gym, etc) that we are paying for. It certainly isn't viable to run a bar/restaurant without getting passing trade from non-residents but there may be ways that RMS can control what they use. I personally urge anyone with any concerns to contact Mike direct and let him know your thoughts. I have also suggested to Mike that he contacts everyone to perhaps ask for owners' suggestions and clarify his own thoughts on this so that we're all kept in the picture and we're not just getting one side of the story from emails that could be biased for whatever reason. I have emailed Mike with my concerns - I too raised concerns quite some time ago (like Rocky) about the location of the bar and suggested it be located at the site occupied by the offices.... to me it made a much better business prospect whilst satisfying security concerns..... I dont object to a bar and restaurant persay but I do object to an open site and free use of amenities that we are paying for.... Once again the lack of information seems to cause friction and it does appear that only some people are privvy to what is actually going on.... sadly I dont seem to be in the loop..... I hope Mike responds to everyone and whilst you might not like the newly appointed Res Assoc (Im not aware of any opposing R.A.) it seems to be the only body who gives me information at all..... | Andy I am not on anyones side, I was just stating that I maintain my original view that a bar would have been better sitauted roadside...this would have satified everyones needs, Mikes, owners and residents and outsiders. The bar has been well fitted out and I like the design....perhaps it is not too late to relocate it and utilise the exisitng room as a meeting point with dvd,cd and reading library? For those who have not been involved in a complex before I can understand that they have not seen the problems experienced in opening a gated lhigh quality complex to the public. I do understand that even opening it to outsiders may not guarantee financial viability. |

| If something was to be done about siting the bar elsewhere, this should have been addressed months ago. To be honest, I can't see the units at the roadside could be attractive enough. Whether you're for or against it, I think we've got it where it is. I think it is important that there are signs clearly pointing out that the pools, gym etc are for the use of owners only. You cannot in all reasonableness prevent customers using the toilets, but there should be some contribution to the associated costs so that owners aren't paying for visitors use of water etc. If there is widespread abuse [from visitors to the bar] using the pool etc, it must be for RMS as management, as well as owners of the bar, to deal with it. Given where we are, I think we should "wait & see"- if there are problems with visitors to the bar, then these clearly will need to be addressed. Until then, I'll be in the bar taking constant abuse from Andy about my footie teams performance [or lack of]. |

| Arthur on the roadside upstairs could have been great with a panoramic view of the development and a sea view. The offices could then have been where the bar is or possible in the unsold one bedder we could buy it and rent it to RMS... |

| The weather was good while we were there over the New Year week with daily sun so lots of living outside but you do need a jumper in the evenings. No electric blanket for us but we found we didnt need it at all the reverse air con does the trick if you need an instant burst but our log burner was absolouteky fab and we spent evenings in curled up on the sofas. Immersion heater used as no hot solar water to speak of but we got into the habit of remembering to turn it on when needed. Thank you to all we met for the good times we had and I hope Marisa your head was ok after New Years Eve. As always far to short a visit so much rushing around at the last minute to get away so we missed saying our goodbyes to some so apologies. We met visitors from Seaterra on New Years Eve who were very impressed with the site and the bar. Loads of opportunities to meet with other SWBayers and its great how friendly and helpful everyone is. Cant wait to meet more of you in 2010 Sheila& Phil |

| OK Andy we have email contact again thanx 4 the internet advice. Well its the 5th January here in Somerset and it is the first we have seen of snow looks like a covering today. | re the snow , here in wigan everything shut and ground to halt ! never seen snow like this scince i was a nipper, when will it stop? we usualy miss most of the bad snow as it normaly comes east to west and the west pennine mountains stop it but its come straight north to south and its BAD! should have stayed at SWB with marisa and kurt andy |

If it was Talat, what was he doing at Larnaca? Give us all the gen ... | Kathy, SWB is a fab site it won awards this year. All the units are complete the site facilities are all up and running and this summer will see huge growth both in the gardens but also usage from owners. Our bar is now open which is a great meeting place. As Arthur says visit all the sites in the area you want to live in and make up your own mind but SWB is well worth a look I dont think you will be dissapointed. We have a villa and love every bit of it. In the meantime ask site specific questions on here and we will help all we can. Sheila |

| Hi Kathy read all the SWB threads but bare in mind there are a lot of us that all know each other so ignore the "in jokes" Once you have bought join us on the facebook owners group there is a big following and we all help each other out. There are a few of the smaller garden units that will not have sea views but when you go out just look at everything. If you are looking at buying a penthouse apartment or a villa you will have the roof terrace and the sea and mountain views are beautiful. Ask away we will all help as much as we can. Sheila |

| Surely an owners association should be for all owners not something run behind closed doors and on a private forum (where owners are locked out if they challenge something, which is what has happened to me for asking a very basic question to which I have still not had an answer ) Without the majority of owners signing up then how can this be democratic, in fact there are many owners that have not even been approached. If they have a majority of owners who have signed up [i.e. over 50% of units have joined], then I am happy for them to represent the views of owners, and if I disagree with the views of the committee then I shall express my views democratically through the Association. | Keith, I have not been given a full list of owners from Mike I have compiled a list from meeting people and other owners have passed their friends and neighbours email addresses as they wish to be in contact. The Facebook group is open to all owners, as I posted the invite on here, and includes people from your group, so it is not exclusive. Whilst I agree I was invited to join your group, once I had asked a couple of very basic questions I was sent a very condesending email from Shaun McCarthy in which he refused to answer them. I have not refused to join and I did not ask to be taken off the mailing list but I no longer receive anything and was excluded from the private forum again not at my request. I am still awaiting answers to my questions. In the interest of openess and honesty please would you confirm the names of the founder members and the number of units signed up to your group. |

| I don't think you will get an answer Andy, they are hardly likely to admit that there is one amongst them that won't pay. We shall wait for RMS to name and shame them. Just reading Keith's e-mail above, there is such bitterness in his post, we certainly don't want to belong to such a group where you can not ask questions and expect to get a civil reply, and where he twist things without facts, Sheila clearly invited ALL owners to join the Facebook group, so had he wished to he could have joined. Without the majority of owners joining his group, in my view, it will not be legit, and nothing that they vote on can be forced upon us, so I think we should all sit tight, just a little longer, until Yoav, completes the legal side for us, then we can truely set up an fully inclusive Residents assisciation, that will benefit all owners and a group that will work with RMS and not against them. |

| I don't think discussing this sort of thing on a public forum does the complex or anyone any good. Sheila if you have not done so already perhaps you could send or resend an invite to the owners of the "other association" to join the 40 of us on our Facebook group. We can then discuss things hopefully amicably and possibly avoid splitting the owners off the complex in to two groups. The other option is for Keith to re invite owners to their private forum, as I was also given the boot from it and i had never even posted. Its time to stop bickering and work together for the common good of our amazing complex. |

| I have to say you SWB lot must be in line for an award as the most productive thread around as nobody gets really arsey and slags others off. In respect of the non-payers i chair the site where i bought my apartment its easy to spot them that haven't paid those with a penthouse have notices identifying their apartment block and number the communal area remains untouched. Those with garden apartments are even easier you can't see them for the 6 foot weeds. Name and shame and if they have rented them out long term see if you can find out who the letting agent is and then go and nause them up. If all else fails use PLAN Z, put them on the rack and get Andy-f to tell them his fishing stories, trust me they will pay then. Good Luck................ |

| ok its happening again - slagging off...if you remember an old forum I forecast conflict especially between those that live on site and owners with pure vacation interests!!!!. We will get nowhere arguing in public as N4Me said. I know from experience that RA meetings can prove long and painful including insults. I too will wait for the other RA but feel the only way forward in one totally open RA. I feel there are too many unanswered questions on the existing RA and its constitution. We have the Cyprus problem and know we have the Sweetwater RA problem. This is probably as difficult to resolve unless people clearly cooperate. Arthur has made some good points on the RA and whilst they do not appear to be answered perhaps a few of us could meet May half term at SWB for an open chat re our combined objectives. Shaun are you up for it as a spokesman for the exisiting RA? plus say 3 to 4 of us doubtees with a one hour max an agenda and an efe or two. A large meeting would not work. |

| N4ME, I don't disagree with you. However, I can't simply let comments by Keith which are patently not true stand without being challenged- if they aren't, they will be acknowledged as "the truth". The fact that I have posed specific questions which he [and others from SWBOA] fail to answer speaks volumes. If, as they claim, they have answered the points raised, it would not harm them to indulge me and inform others by repeating such answers. In the past I've received rather silly threats of legal action from "Rhodesian"for "defamation" etc, which having read some of his postings and those of "Milou" makes those threats somewhat ironic. I think most fair minded people want an association which works for the benefit of owners as a whole- we have a great site and I want it to be run for the common good, which I fear isn't necessarily the case with all. On a lighter note, I think Andy F is wasted erecting satellite aerials, I think a stellar career in the diplomatic corps beckons !! |

| Here, here Rocky - I think that a meeting needs to happen with Shaun and we need the facts from him up front - no hiding anything, that way we can move forward. I did request a meeting at New Year but he was away so it couldn't happen. Ideally, we need one RA but we need it to work for the good of SWB and for everyone who has bought there not just the "few". However, I don't believe it will work if we can't build the trust that it needs; perhaps we all need to bury the hatchet and start afresh. |

| arfur mate today was a gruller, its a winter league that we are fishing , the first match was on anglezarke res three weeks ago there was sixteen blanks ( i was one of them maximum penalty points five ) last weeks was cancelled due to ice , todays should have been on upper rivington but again iced off so match was moved to the zark ( anglezarke) i caught a tiny ruff and a roach for four ounce third in section so three points . i know you think we are mad sitting in freezing temps but its better than sitting in the house with her indoors ! lol andy |

| We have been forwarded minutes of the first SWBOA committee minutes, which are a bit like the Curate's egg, good & bad in parts. With the absence of any other association appearing [although repeatedly promised], this association can be considered a step forward. There are some issues and points that they have raised which I think are perfectly valid and should be addressed. I hope that SWBOA will put their minutes on the forum for consideration by a larger audience. However, I would still ask that the following points are answered: 1) are there any committee members who still do not pay their service charges? 2) how many owners have "signed up" to SWBOA 3) as the M&As of SWBOA specifically exclude SWB from having any vote in respect of the units they own, what are SWBOA doing to rectify this? These are issues which [in the main] have been raised before & Keith tried to fob us off without answering. Let's have some straightforward answers without prevarication. |

| anyone else received the e-mail from swboa regarding the maintenance qoute from vistamar ? they are the company who run seaterra bay and marina. i must admit it raises a few questions like how come they can do it for £ 200 a year less than rms ? andy |

| Looking at Vistamars tender its a case of you could pay less I agree but you will also get a compromised level of service. I would also hazard a guess that there would be a shortfall due to the low budget figures if you compare them to the actual costs in the RMS accounts and budgets. |

| I'm afraid as Jackie's daughter has our printer, I can't print off the costings done by Vistamar, but Sheila is very organised and no doubt can make a comparison on costs. As RMS charge a specific fee for their management, and actual costs for expenses are in their figures, it would be interesting to receive an explanation as to if and where cost savings can be made, with the exception of SWB having appointed MEPS for two years to carry out the gardening. I have no objection to RMS being held to account for the costs they incur for us on site [& in fact welcome it], but it strikes me that SWBOA are from the outset trying to pick a fight/replace them. Does anyone have anecdotal evidence of how good or bad Vistamar are? Despite Loulouis' comments, it must be for the benefit of all SWB owners for issues to be raised and discussed on this forum [not all will be on e-mailing lists]. I'm disappointed but not surprised that "Rhodesian"/SWBOA haven't answered questions posed previously. |

| If North Cyprus (for what they are worth and are they experienced in estimating site maintenance fees?) said just under £50 a month in 2007 are the RMS fees unreasonable in 2010? Of course it will cost more per unit if some parasites are not paying also I think non payers should be named and shamed and the SWB developers should be applauded for paying fees on unsold units. Shaun are you ready for a meeting in May? a few of us would be interested in an informal chat on the way forward. . |

| The point about Sea Terra Marina is that the gardens are weeded, the grass is cut, the pools are cleaned, the stairwells are swept, the gym and toilets are spotless and all is neat and clean for £45.00 per unit per month. They should at least be able to achieve this here at SWB particularly as our gardens are much less labour intensive because of the gravel and we have less garden and much smaller pools. Instead we watch 3 workers from MEPS appear every Monday (one day per week) morning at 10 am - take 1 hour for lunch - continue for a couple of hours in the afternoon then go and tend to private garden/s. At £20,880.00 per annum, that works out at around £20 per hour per labourer - this is not good enough. Mike said that he will review this after six months but if he has a contract how can he review this or don't contracts mean anything? | Milou its not all about whether the grass is cut and the garden is weeded I will tell you what we now have that we didnt have before, don't be fooled! the most important thing we have now is 1. A management Company that respects all owners 2. Full receipted audited accounts 3. Complete transparency in where all our money is spent on and full consultation on when and where it is spent 4. A swimming pool that is fully functional and no leaks 5. A sewerage plant that recycles water from the irrigaiton saving us £1,000 of pounds 6. A well producing water again saving us £100's 7. No non-payers 8. On going improvements to the site 9 A happy site all of the above was not there whilst under the previous management !!!! |

| Also just to clarify that we do not have the luxury of economy of scale we have the same are of grounds but only 88 apartments, whereas the Marina has 162 apartments twice as many the only extra thing they have over our site is 1 extra pool. |

| Hi MM as Shaun has started two threads on this forum I am sure he has viewed C44 on occasions. If not there is no doubt that other people on site or visitors may converse with him from time to time and have mentioned that a few of us would like a one to one with him. I must add only a meeting not a slanging match. I am sure he shares the same objectives as other owners I would happily meet him on a one to one basis. We are told there is another RA being formed surely the objective must be to have one RA which is stronger and completely open and represents all owners. It is my view that only owners who have paid their mainatenance fees should be allowed to represent owners. I believe that we should work with RMS for the time being in a completely open manner. RMS should be prepared to open their financial books to us due to the allegations in a previous message and I am sure MIke would not oblect to this. We should also welcome SWB paying fees on unsold properties also. Vistamar why?? |

| Hear hear Rocky. The well documented point is that there is tangible evidence that some individuals decided [even before RMS took on management] would be working to get them out. It speaks volumes that rather than answering the points they have gone strangely silent. on the positive side, I am prepared to discuss matters with Shaun when I am over in either March or May. The preconditions must be that: a) only paying members are on any committee b) RMS [or any successor management company are only voted out by a majority of owners] -otherwise we have a recipe for chaos c) I don't think any management company can be owned by owners/residents on site [I don't object to owners being employed by that company]- it would be too incestuous. The SWBOA budget has a fee for management of 30000ytl [£12500]. I'm afraid I'd stay in bed, or at best simply have a swim in the pool [even if non paying owners think it's "dirty"]. |
