Hi its Roachie, I posted a message three weeks ago about squatters in my house and received lots of replies saying the difficulty that I would face getting rid of them. Well I did so. Because the squatters had a prominent Cypriot father, two Cypriot newspapers were interested in printing the story and I used this as blackmail to get rid of them. I also threatened to drag their good family name through the courts.

im so glad for you, sometimes things like this work because if the family have a good reputation, threating them to blacken their family name does work sometimes this is more of a detereant than leagl procedings

again well done and consider this as a lesson taught you wont be doing that again in a hurry

My family and I have a house near Catalkoy and had intended to come to live in Northern Cyprus. Over the last few years we have come to stay in the house as often as possible usually for around 3 months in total. We had intended to come this summer for seven weeks. In order to try to ease the current financial problems, we rented (for the first time) the house to a cypriot family between October and 30th June. This was all fine until February when the payments stopped and they are now refusing to leave. I am at my wits end over this and do not know what to do. They have also stopped paying the electric and water and both have been cut off. We are coming to Cyprus on 21st July in the hope that we can find a solution. I am hoping that someone may be able to give me some guidance as to how best to sort this out. Please - I just want my house back.

Did you rent your property through an agent? If so, what is their advice to you? Did they get references? Take the advice of the original poster and get as much information you can on these people to see if there is any leverage in shaming them into leaving.

Failing that did you get your rental contract stamped? If yes, then get your advocate to write to them and threaten court action.

You are so right when you say "did you get your contract stamped" so many people who rent out their properties fail to do this, or even fail to draw up a contract and get it signed by both parties. I know the reason why people fail to do this is because they then don't need to pay the 10% rental tax. I am not saying that this happened in this case, but there are lots of people who do not pay the rental tax. I have been shouted down on this board for warning people not to rent to locals as they have more rights than you as the foreign owner does. I do hope this situation can be resolved without the need of lengthy and expensive litigation but it will be the owners who will end up paying the outstanding electricity bill to get it reinstated in their name once the squatters leave.

Can you please explain the 'rental contract' and what safeguards this gives the person renting the apartment to a third party. I didn't realise there was such a thing.

There is a contract but I don't know if it was stamped or not as it was organised by a friend in Cyprus. What would happen if I just walk in and sit down with my family?

Well done Roachie, obviously a nice peaceful and obviously effective way to deal with the situation.



As a small sidetrack ref: msg 13. I am really not sure how the rental contract would help in this type of situation unless of course the fact that paying the 10% tax and getting the stamp makes it an official contract in the eyes of the local law and as such will have dates for when the renter needs to move out or renew contract.

The only reason we as renters asked to have the stamp is that it is needed to be able to get residency although I am not sure how this would improve the situation for the owners.

Msg 14. From expierence even if you have a contract you would be breaking the law if you tried to gain entry to your house .You may go down the court route but once again the court would favour the tennant over the landlord and give them sufficient time to find a rental of the same quality that they already have.Remember all the time you are trying to get them to court they are still occupying your premises and you cant forcibly remove them.If as previously mentioned you have not registered your property as a rental and have not been paying your 10% tax you will be further up the swanee without a paddle. Sorry to be the bearer of bad news but that was the situation 2yrs ago.It would help your cause if you had a Cypriot friend to appeal to them on your behalf

The people have said that if I give them another two year contract they will pay all the monies owing in cash. The cypriot friend who organised the tenancy has offered them another house but they have said that they like my house as it is comfortable and private (such a cheek!) and that the neighbours of the other house are bad people. It feels so wrong to give them another contract. I have loved TRNC since we honeymooned there but this is turning into a nightmare.

The lawyer says we can either give them the two year contract (but I have heard that this could make it even harder to get them out). I have suggested that, as they love it so much, maybe they should buy it from me! I am waiting to hear back and have just found out that they have two children and another on the way - no one told me this before! I have been told so many different stories that he is works for the government, that he is a teacher and, if that is true, I guess I could write to his school. I just can't believe that this is happening. Why do people have to be so horrible.

so many stories nearly all the same , shouldnt we start a campaign to get the law changed all landlords worked hard for their money and property or maybe some one should start up a company just to oust non paying tennants house bouncers. what do you all think.??

PARADE OUTSIDE HIS SCHOOL WITH A LARGE BANNER !

Shame him, and annoy the school heads, tell him & the school that you are going to write to ALL the local papers, including Turkish (you can surely find someone to translate) 'Naming and Shaming' him and his family.

Ring his parents and tell THEM what you intend to do, and ask them if they want their name dragging through the mud!

If that doesn't work, post back on here, and I'll think of a few more things

Tenants unpaid rent Mr xxxxx of 44 Lets be Soak Catalkoy is at present 2300 tl in arrears that amounts to 6 months rentwith a futher payment due on 15/7/2010 If this is not bought up to date by 1st of August 2010 court proceedings will be entered into fro the re possession 0f the home and expulsion of the tenants for non payment

If Banks can put in notices why not you

I am trying to find out for definite if he is a teacher. The newspaper idea sounds good - maybe the threat of this would be enough. I have emailed the British Residents society to see what they say. Would the British Embassy help?

I don't know who or what to believe any more. I usually really look forward to coming to Cyprus and my family say that when we touch down at the airport they hear me exhale! but this time I am dreading coming, I feel sick at the thought of it, even though I know that I have no choice.

No, absolutely. The British High Commission is not known to be the most helpful at best of times. But in this case they will probably refer you to the Foreign Office warning not to buy in North Cyprus.
