Diahatsu Terios (Very small Jeep like Vitara). Blue and Silver. REG: EY 347 Can you help. We used to own this car back in 2007/8 until is was written off in a major accident. We then sold it to the garage that had it in storage. However, it seems that the garage rebuilt it and sold it on. The problem is that they did not get the new owner to change the log book and the new owner has just comitted a driving offence but the police records still state that we own the car. The police have told us that we have 14 days to find the new owner and get his details. So can any of you help. Lets hope so or one of us will be banned for driving a car we do not even own!! If you have any info on the whereabouts of the car, please email moreinfo@systemlogix.co.uk Many Thanks

The garage should be liable in this case. Typical that the police would blame the previous owner. The law here is an ass.

If a car is written off it is purchased by the insurance company in which case the original owner has no right to sell.

I do not think insurance and payout were mentioned by Andy. He has sold it to garage as a wreck, the garage has not put kocan into their name. Garage have rebuilt, probably at little cost to them, put it back on the road as a "runner". Some punter has bought it and again kocan not signed over. Therefore any offences are charged to Andy, his error in a way because he did not sign over the documentation because he assumed vehicle was being used as spares. Even when "scrapped" kocan must be transfered.

Andy, It is up to the new buyer to have it registered into his name. You sold it to the garage and you have already told the police which garage. Let the police sort it out between the garage and the new owner. If you do not admit to any wrong doing, the police cannot fine you for anything and no traffic points earned. Let them take you to court if they will and you can explain it all to the judge. You are not responsible for any traffic offence committed by someone else. As simple as that. I have eight unpaid tickets from fixed speed cameras and nobody asks me anything when I travel abroad, no reason why they should. ismet

Ismet With your bad track record for speeding, amassing a collection of yet to be paid tickets, will this prevent you from standing for President or are you waiting to be voted President so that you can pardon yourself the outstanding fines?! Anyway, it's a pretty good reason to stand even if you don't have any concrete policies to spout off about! Richard

proger1: Unless things have changed in UK, If your car is written off, the insurance co. pay you the cars value less it's scrap value. It's then up to you to dispose of it. Tony ps good to see all that Aussie sun and xxxx hasn't mellowed you, Richard.

Watch with the going to court thing after 15 days the fine doubles . it then doubles 15 days after that then u can go to court. I am serving a ban at the minute for that reason. I didnt want to risk losing in court over a fine 4 times bigger than the one I already had. I feel sorry for you a bit. you tryed to use the forum for a purpose it was meant for then you get 18 answers to a question u didnt ask. No sorry I didnt see the car but If I do by anychance Ill be sure to let you know where and when.

If the only replies have to come from somebody who has seen the car, and nobody has, then there would be no replies. It would look like nobody was interested. At least now Andy knows that his post has been read and at least three of us, apart from Andy, will be keeping an eye out for the car. Tony
