1) THE VILLA.

3 bed Villa in Karsiyaka master has ensuite and a large verandah and also its own outside staircase 2 other beds downstairs all with fitted robes , the open plan through lounge/diner with L shape kitchen has sliding patio windows at both ends 8X4 private pool and easily managed gardens .pavior driveway with parking for 2 cars. Tarmac road with street lighting mains water and electricity quiet road but within walking distance of Karsiyaka square .

2) THE PAYMENT

I am offering this Villa for sale at £80,000 with an absolute garrantee that if you have not received your deeds within 3 years I will repay the £80,000

3) THE GARRANTEE.

The money will be put into a Joint account with a contract drawn up by a suitably agreed solicitor that will basically say that neither party can draw out the money without the others consent.

This way the buyer has the assurance that if anything goes wrong with getting the deeds he can at least get his money back.

Can see lot's of problems with this situation.



If your really desperate to sell why not agree a rent which can be deducted from the £80,000 agreed fee to be paid over on completion of received deeds,

why would there be a lot of problems or are you just another expat whose pint pot is half empty and no I,m not that desperate to sell but I do have a big villa in lapta and keeping 2 houses going is not cost effective

Scootex, excellent idea and I believe it covers the NO KOCAN, NO MONEY! philosophy even if you have not got your deeds. If anything you are being too generous as I can forsee the possibility of someone with a criminal record (and therefore unlikely to get PTP) living there rent free unless you put in a clause that allows you to keep the interest.

Good luck in finding a buyer and finding two solicitors (I assume one being English based) acting for your purchaser who can agree the various clauses.

Even better if the £80,000 is held by a UK based solicitor. Even if this is not a rental agreement I believe it would be best structured like that, with a right to buy at the end of the 3 year period. With that kind of deposit it would be a very safe rental and rent could obviously be charged, which is an advantage.

Scootex....it sounds like you are trying to give potential buyers some reassurance,which is great.



Are the deeds currently in your name,or are they still held by the developer/builder?



If they are still held by the developer what would happen if memoranda were lodged against the property in the interim period?

Sorry Cronos completly missed your post must be old age .

Anyway to answer your quetions

they are still held by the builder

If there was a case of the builder adding a memoradem to the deeds before completion the purchaser getting the deeds in their name the £80,000 would be imediatley refunded as per the intended contract but the purchaser would have to vacate the premises unless some rental agreement was made .
