We bought our villa in 2003. We still have no Permission to Purchase. The title deeds are still in the name of the builder. We have registered the contract and paid stamp duty. Does this mean that we are 100% protected from the property being sold, or transferred to a third party, by the builder?

You will be better protected if the contract is registered with the Tapu Office.

Hi derby, Have you checked that your lawyer has actually applied for permission to purchase? Have you got your application number, so that you can check yourself. 2003 seems a long time to wait for it, as we bought in 2006 and received it in 2008. Have you bought pre 1974 title? The Tapu office is the land registry office which is in Girne next to the law courts. The butlers wife

No you are not protected. You can still have a second charge put in behind your contract which if you registered it, you have rgistered it with the tapu (land registry). Stamp duty paid means you have a legally binding Contract, but that means very little here, Kulaksiz 5 paid their stamp duty and they are likely to be evicted, so it means nothing. My advice, contact whoever applied for your permission to purchase, get your ref.it will start with 2003/**** If you are not here, get someone you trust here to go to the permission to purchase office and check for you, you may well have been granted it without anyone ever telling you. Then, if all else is ok you are ready to transfer title to your name. Do it as quickly as you can.
