We bought a property in Karsiyaka 3 years ago built by this company. We have just received our PTP but despite asking our Lawyer to contact him to arrange for the transfer of the Kocan (and he tells us he has not done this as the builder does not receive post and will not answer the phone to the lawyer) we are not able to move on. Is there any way to bypass the builder and get the landowner to sign over the Kocan for your bit? Does anyone know the answer to this bit? It seems to be worse not knowing the facts, and it seems that the lawyers are not able or willing to tell you what you could be doing. I am quite willing to sue this man to enable transfer but obviously this is a high financial cost which may, after all, not lead to anything at all!

Hi Sue, We received our ptp 15 months ago but unfortunately you cannot make your builder/developer transfer title deeds. I don't know if you live on a complex but if you do, the site will need to be parcellised first. This costs money and takes time to get done and then I am given to understand that it takes up to a year or longer for title to be transferred after this. The butlers wife

This is a site with 4 houses, then a little road then another site with 3 houses, mine is one of the 3, We were told that only one deed would be issued for each side of the road, ours would show that we owned a third of the whole thing. All sounds a bit dodgy to me.

Many thanks to the Wanderer and DeputyDawg (is it really you Bean?) I think I may even give up on my lawyer and go and see Naomi Mehmet. Is she as good as she sounds?

Sue, it really is Mr Bean ! I am loathe to recommend any Advocate here but I am prepared to say that I have been told by several people that they were well satisfied with her services. Your question has been answered by Naomi "lack of specific performance", unlikelihood of enforcement following judgment" etc etc. Do not worry as you still have Mr Bean ! I will telephone you tomorrow xxx
