| I prepared a video on the subject and intend to send a copy to each MP on CD first thing in the New Year. Hopefully somebody will take notice and start thinking about it. It is all in Turkish and is 19 minutes long in two parts. I explain how the problem can be tackled. | Elko, may this make some heads turn on behalf of expats and TC's alike and everyone who has tried so hard to make this place their home, I like so many others thank you for all your advice and support over many issues. A suggestion I would like to make, could you please also send a copy of this to the President of Turkey, because if they agree with what you recommend, then maybe, just maybe, they will kick arses here and so relieve themselves of the burden TRNC has become to them and force them to become self sufficient. |

| Whilst any move that helps solve the scandalous property situation in the TRNC is to be rightly applauded, before doing so, it would be prudent to know what was being advocated. I too would therefore welcome an English translation before giving my support. |

| About the video. It starts off with a caption about how the construction industry in TRNC can be resurrected. A short breif about myself followed with an explanation that north Cyprus had two bright periods after 1974. First one called the Asil Nadir period based on exports of citrus fruits and the second good period just after the Annan Plan with an explosion of the construction industry based largely on foreign sales. Then came the problems and the injustices. It will be very difficult to put right the injustices but we must try. The Kulaksiz affair is just the tip of the iceberg. However the priority must be given to putting the system right in order to avoid the risks and injustices. Now the sales tro expats almost stopped and the new customers are scandinavians and the Russians but it will not be long before they face the same problems and stop buying. Then I went on to list what should be done. 1. Cancel the Specific Performance law and amend the contracts law accordingly. 2. If the Vendors fail to register the contract within 21 days they should be penalized. 3. The buyers should be able to register at any time with no time limit. ctd. |

If any property is sold with a mortgage on it without prior knowledge of the buyer, the contract should be voidable when the mortgage is found out and if the vendor is not able to pay back the money with interest it should carry a prison sentence for the vendor. 5. The registration of the contract should give first right on the property to the buyer i.e. no more memorandums due to debts of the vendor. 6. Permission to Purchase should not be linked to any specific property. Military areas etc. and possibly pre 74 Turkish land should be subject to special permission. The list above can be achieved very easily and I am willing to draft the necessarry legal changes or help with the drafting without any expectations for personal gain. Finally I would like to see the government run on rules and not personal favours. I know that this is utopic but we must not lose sight of such a wish. ismet |

| looking at No.4. Surely if the Advocate does his/her job properly, this should not be able to happen? Because sending the vendor to prison wil not help the purchaser recoup their money. Also the Advocate should have a 'duty of care'. Not a criticism Ismet just helping refine your ideas. At least YOU care, let's hope the government begin to. |

| msg 13, Polly, There is no simple way to legistlate directly to hold the advocate responsible in such an event because it all depends on the instructions given to the advocate by his/her client. We have such a case on our hands. The property had four mortgages on the land and the sale contract specifically stated that there were none. Despite the Registration of Estate Agents Law there is no mention of the name of any advocate on the contract but neverthelesws it was registered. We are looking at various possibilities and thus I cannot give any more details at this moment. It is a myth that advocates cannot be held responsible. However negligence has to be strictly proved in court. We have no qualms about suing another advocate if we have reasonable proof in hand. ismet |

| Thank you Ismet for the translation of the main points and I wish you every success in your endeavours to bring this to the attention of the government. I think one of the problems is that developers point their clients toward an advocate that is acting for both parties, things then get covered up as they are being paid by the developer to hide things. | It's unfortunate that there is little incentive it seems to politicians and civil servants to do anything whilst they are receiving inflation proof wages and pensions with little if any chance of losing them. It's not as if they are in any danger of being brought to book or losing their jobs for doing nothing. How many have more than one job? How many have their family and relations in similar employment? To what extent are the politicians, civil servants, planners, advocates, estate agents, developers, builders entwined with each other? |

| I will be giving a copy to each MP on Tuesday 4th January and other places. However the Constructors Union already have a few copies and the Board of Management watched it together. They contacted me and we are going to cooperate. They are in full agreement with my points. Their legal adviser, a retired attorney was present who happens to know me well so that made things easier for me. ismet |
