Does your trnc will need to be lodged at the Court? Or is it sufficient to make your will with the Notary and for them to retain it?

In my humble experience (relatives in Turkey), you have to have the Will lodged with the courts. There is a cost. They give you an number (like a reciept) this means it is lodged.

You do not have to lodge your will with the court however I advise you strongly to do so. Anybody can draw a will but it is subject to strict rules and if not adhered to it will not be a valid one. Therefore I advise you strongly to employ an advocate to do it rether than a "Certifying Officer" passing themselves off as Noters which is not legally in existence in Cyprus. Certifying Officers do not require any legal knowledge and they are not subject to any exams. You pay your money and you take your risk. Its a free country!! ismet

Having said that, "advocates" in north Cyprus are no such thing and simply hold a law degree - the same as thousands of students who leave law school every year. Do they have to do any kind of training for court work or gain a practising certificate like real solicitors in the UK do?

PtePike, Anyone with a law degree may be called a lawyer but in order to become an Advocate in Cyprus (both north and south) you must have approved legal qualifications, have one year training with an advocate who has a minimum of 5 years practice and also pass the Bar exam. ismet

If you have children from a previous relationship it will pay you to have a will drawn up in TRNC because the laws on passing on property are very different to the UK

We have children from previous marriages and it was essential we had Wills drawn up in TRNC, going rate seems to be 100 pounds per will, and you have to have them done individually. Our Joint will in the UK does not cover our interests in TRNC.

When I sold my house & down-sized 18 months ago I made a will here in Scotland and my solicitor did not charge me ANYTHING. In N.Cyprus I also made a will when I bought an apartment, and was charged just £80 (Scottish lawyer was with local firm) It is essential to make a will when you buy property. I fully intend to live life to the full for a good many years yet, but we are all mortal, & I would like to feel sure that my 4 children & 2 grandchildren would benefit from my hard-earned properties.

Done ours with the advocate then taken to the court to get it registerd, as said before cheap for peace of mind.It would be a lot more expensive if our children had to fight for what is theirs if anything happens to me or the spouse.without a will. The lawyers in the UK would have a field day with there charges, what the cost would be in NC would not bear thinking about, that's if you would ever get it sorted

Hi Throstle Are you a baggies fan with that title ? TRNC wills may not be legal in the UK but, leaving property in NC needs to be covered in the NC.
