Yes, purchased in Dec 2008 received PTP end of Nov 2010 and have a receipt from the Land Registry office where the Kojan is being hand written, will take a while as there are quite a few before ours but not worried at all.

lucky old you:- I applied for my PTP in 2004 finally got it in 2008 unfortunately the house I applied my PTP for is not built & cannot be built safely it's just a shell on a ledge! no deeds, no house, just my life savings! plus my late husbands life! all gone, along with 7 years of heartache!



You are both so clever, you have bucked the system!

If I was in your shoes I would be really worried!



Anyone in 2010/11 who had any sense would not pay one penny until they have their DEEDS!

We got ours in late Sept, we were over for 2 months, so called in LR office every week, smiled sweetly and asked any progress, gave the lady out land number. 6th attempt lady said wait for half hour and hey presto, there it was in our hand.

You obviously arn't and I am not, the construction company with an excellent rep has signed everything they need to everything is great, I have the receipt from the land office and the number in line we are for the Kojan to be written oh and we live in the house as I bought a completed property not a picture of a property and actually done my homework, just because you are a victim (and yes I do sympathise with you) does not mean everyone else is going to be one there are more happy endings out there than bad ones.

whilst im sympathetic to your plight and purchase ,i dont see my self as "clever".

i spend 2 years meeting estate agents and trusted the one i went with ,again more by chance .?

i looked at the builder ,whom had accounts to be viewed on line in turkey ,not clever just seeing if they were cash rich enough to carry out what was being asked.

i purchased off plan ,whiuch can be dodgy i agree.

and again not clever but only paid the stage payments when they were built .....even then i agree the kocan bit can be scary and can noy happen as planned .

luckily i met the landowner a few times and not just the developer ....not clever just trying to see peoples faces when you hand over cash ,so at least you know who run over in dark night if they dont do what you pay them for .

A complaints department bases the success of its product or service on the % of complaints it gets, there is no other easy way of finding out. If 5 out of 100 have major complaints then this is usually a sign that the company is doing something wrong and should accept it and improve it if they are to avoid bad publicity. 5 out of a 100 would probably amount to about 1500 problems out of 30,000. That seems to be about what is happening in the construction industry. Trouble is with the accept it and improve it bit. Problems happened, that's understandable, but to shrug your shoulders and say some of the things I've heard on this board and from government officials is insulting to say the least.

PTP Dec 2002, Deeds April 2003. Bought the land first then waited until I had title deeds before starting building. Even then, as a law lecturer, I felt like an idiot paying for something in full 12 months before I actually owned it.

Mine is esege - took the ptp three years to come but it finally arrived in December of last year. I want my deeds now and will even pay the builders stoppage etc to get them but my solicitor just says, no, they have enough money to pay their own.



I am worried enough though to pay up just to secure the deeds. Is it possible to bypass the lawyer and just ask the builder to go in and sign the transfer forms?



Just simply do not understand the procedure and the lawyers want to keep it that way I think!

It is a difficult one Sue. Legally it is the builders responsibility to pay his own taxes and it is blackmail to ask you to do so. It is becoming a common request and your advocate is right in that it should be the builders total responsibility. Do you think that if you had said," I do not have enough money to pay for my VAT" he would have paid for you?



However I can totally agree that to safeguard your home, you need the deeds. Without the deeds you do not legally own the property, it still belongs to the developer. This means that if he does not pay his debts (most builders use credit for buying land and materials) his assets can be seized. One of those assets is your house! There is an increase in purchasers now discovering memorandums on their property.With the fall in property sales and the lack of constructive action by the Government to prevent this from happening, it is bound to increase.



So only you can decide which action to take.

What is important Sue, is that if you decide to pay his tax, you do this in a way that gives you the certainty of obtaining those deeds. Remember there is no legal obligation for him to hand over the deeds even though you may have paid.



I would suggest he hands the deeds, signed, sealed and delivered to your advocate before you pay over any money.

Very grateful and feel a bit more confident now, I will go and tell the solicitor to sort it and that I will pay the dues and that he has to actively sort it out. He is a bit lazy and tells me that it is no good writing to the builder as he does not accept Post!!! I feel as if I am fighting both the lawyer and the builder on this front.



However, I am extremely grateful to you for your comments. I know that the landowner in my case still has the deeds so the builder definitely cannot use it as security for a loan. The landowners are an elderly couple and actually very nice Cypriot people so I do not feel unsafe that they have the deeds, I am mostly aghast that my solicitor is not doing what he was paid for.

Sue, If the deeds are not in the hands of the builder, can't you deal with them directly? The builders role in this is to obtain final approval of the house, so that you can then get it put onto the deeds.

Pay the dues only when you have the deeds. Under no circumstances pay the advocate or builder beforehand.

purchased pre 74 turkish title in 2002, PTP arrived about 5 years ago, deeds obtained in Sept 2010, didnt wait for advocate to get deeds, went into land registry twice and they handed them over. There are some good news storys.

its a bit like nicking a car then getting your mate to knock you up a "log book" for it................
