| Guessing it is TQB as I had a look in there today. If I was paying a company for this I would not be impressed. It really is a disgrace. Mind you, I believe if the owners contact their company, all will be resolved?? Things are better than they were?? Looks like it!!!! Any comment from the management company?? |

| Hi we recognise these photos as we are owners on this site our apt in in the second phase we have been waiting for the developer to allow us to obtain electricity meters from Kibtek for almost 2 years, a swimming pool is built but has never been commissioned the garden areas are an absolute disgrace, however we are in contact with the management company who we believe try to communicate our frustrations on our behalf from the UK and when we use our apartment are able to meet with them its probably best to keep things that way rather than having the "spats" with other members of the forum which we believe does more harm than good with some of the comments made |

| Dare I say that something must surely be very wrong, if things are taking this length of time to resolve, as I am aware people are paying £60 a month for the upkeep and maintenance of the development, and here we have yet another long suffering owner saying that they are unhappy to say the least, it is maybe time that owners as a collective made a move to put things right, I recall sienna saying in a previous post that you pay about the same as them so there should be plenty of cash to do the job properly - if the majority of owners are paying - IF |

| £60 per apartment per month? A lot of cash! maybe things should be a lot better? As msg 9 - IF ALL are paying! the kitty should be big enough to stop pools getting into their current condition as well as obvious damp etc. that will only get worse as the next few months will prove. |

| Hello the twirleys I own up the top of the complex, who do the management company try to communicate your frustrations to ??, we pay them every month to keep the place properly, and the pool in the pictures was one of the best ones as a lot of other owners should be able to verify, I want to swim in the indoor pool but it is empty and all taped up and you cant get into it anyway even if it was full, I take your point about not wanting to say too much or rock the boat, but is now time for us all to stand up and be counted, after all its nearly 18 months. The developers are the ones who are responsible for the state of the buildings, and the lack of flood defences, but the M/C should be more proactive as well, and they should be at least updating us monthly, there is a small but growing band on a private forum I think you know about so why not go there and see if as a group things can progress |

| Message 14 - that sounds good advice. All owners need to be in contact with the developers on a very frequent basis. You mention a forum which has been set up - I would recommend you all use that forum and not this public forum. Get a meeting arranged with your developer and find out which owners could be available to be present at that meeting - make sure you have owners you can rely on and not ones you know will cause trouble. |

| Any m/c can only be good if everyone pays their fees. Money pays for employees to do the jobs no money if your lucky just keeps the admin side going. Glencoe were very good and did their best, Lynx I do not know but previous postings regarding other sites they do are reportedly well looked after as well. This must indicate lack of funds on TQB. It is a big site how much is sold? if for example only 40% then at best only 40% of maint fees for the whole site could be collected. |

| The big problem is getting all owners to communicate with each other, too many have their own little agendas and dont look at the big picture and as long as that prevails then there will be no end in sight. Am open to any suggestions so long as its not 'go ask the m/c, cos I have tried that and got nowhere and also tried getting somebody to ask the committee but still waiting for anything positive ? |

| Hello Japeal, I think the big problem is there are a couple of big players who are not paying (guess 24 apartments) then probably another seven or eight non payers, some people have paid a year up front and this must be worrying for them now, but with sixty payers @ £60 a month I am reliably informed a good job can be done and all the pools except the phase 2 one could be up and running within a couple of months or less and all the pavements can be repaired in that time frame as well |

Lazy Days again I think your comments are an echo of my words in the past, you all need to pull together to get this sorted out you need to follow the floor easement law and hold those responsible to task (developers etc)- find out where your maintenance money is going and collectively decide priorities - we nearly bought the apartment next to the one shown in picture one, boy I am glad we didnt, It looks like its sinking down the hill. I don't think there can be any arguement that this site is not what it should be and it is going to be difficult one to get it up to a standard - the problem is the longer you leave things the worse they get and all the time the place is de-valuing and will cost you all to get it good working order |

| lazy days how many apartments are there and should be paying £60 per month - I think you will struggle to get everything commissioned with only 60 paying £60 Has the MC given you a break down of costs ie staff, outgoings etc so you can work what you can and cannot afford after salaries and essentials are paid for ? |

| Hi sienna As I said it is possible to do it, I know that the pools could be done with little effort, but everything would have to be prioritised, and the developers would have to be positive it efforts to get things moving again as I am sure they would be as it is in their interest also. There are people out there who have the knowledge and ability to help get things going full steam but only if the vast majority of owners are prepared to go along with it, however I will not hold my breath at the moment |

| It is gratifying to see so much positive input and I am sure if there is a willingness things will push forward, people have to be on hand here on site to see what is happening and to oversee things though, and maybe give everyone a monthly report with unbiased photos and commentary, it is easy to do. |

| Well you did not have long to wait for the alter ego to appear message 25, I think that if the twirleys read this they will verify that the pictures of the pool photographed is in fact the pool that has still not been commissioned in phase two, rather a lowlife attempt to discredit, but of course this had been used before by pipie as a reason for non payment and for accusing the M/C of not having ALL pools up and running, when they said they had, I must admit they left themselves open to that accusation because they didn't give a thought to the non commissioned one thus giving pipie a bandwagon to jump on, also many people who live and indeed know the area will also verify the photos of a builders camp adjoining TQB, what has this to do with a M/C - and the photos of the weeds - well what can we say, but it is fascinating that I saw these first photographs attached to an e-mail from PIPIE to the last M/C, well well enough said. | 18 months on I think Arnolds photos at this stage are irrelevant in fact what they do show is how the site is not moving forward and as difficult as it is for all of you the past in the past -there is nothing you can do abouti it. Arguing and we have all heard the arguements time and time again is getting you no where in my opinion You need to tackle the situation as it is NOW, move forward and then move your site forward. If we on our site had stayed still after our last MC had gone then it would be in the same state, we didnt, we tackled the site bit by bit and are still doing so, because we have a strong committee and a good management company that works with us and most importantly we know where every single penny goes this is where you need to focus on getting too. not this constent harping backwards it doesnt achieve anything |

| So lets do some simple maths as to where the money being paid to Lynx is going. Assume that 40 people are paying £60 per month which doesnt appear to be an exageration. I pay £60 per month for my pool. It is always immaculate. So 3 people's money is being spent on pools? I pay £30 per month for a gardener and my garden is great. So lets say the communal areas and so on need 40 times that amount of labour then 20 owners money is attributed to keeping the garden clear without actually putting new plants in. This leaves 17 owners money to spend on admin and everything else. Problems with the buildings and walls should still be in the domain of the builder so the encumbant commitee and the m/c should be ensuring this remedial work is carried out by them. I walked around this site two years ago when a c44 member was carrying out a vendetta with the previous m/c and it was certainly nothing like the pics from Arnold. Can anyone else back these up with dated photos? |

| one point it cost more than £180 per month for a large pool to be kept - I hear what you are saying but they are bigger than a small villa pool - we are charged £400 per month for ours but is bigger than TB so somewhere in betweeen I woudl suspect but then the MC should be able to give you the figures and costings |

| Arnold/pipie I am NOT Glencoe as you well enough know, I am not a company, nor am I Greg. It is irrelevant that (this person) these people keep up this spiteful vendetta the fact remains that TQB is as we speak in a dreadful state, Sienna has recently visited, Scoty has recently visited as have others and all are of the same opinion, this is about the PRESENT. People on here have been accused of keeping harping back to the past and now the accusers are doing the self same thing, sure we all remember the state the pool on the new bit of the complex was in, with the polystyrene floating in it and all the globules of congealed muck, but that was nowt to do with the last M/C, the fact is it was not and indeed still is not commissioned. | The costings as per the M/C report are £522 per month for maintenance of 2 pools and average £440 per month for garden maintenance, just under £1000.00 per month, then theres the communal electric bills which run about £550 a month, allow another £1000 for other expenses around £2550 a month outlays, pipie said theres very few non payers now and the figure she quoted on here was 75% paying, so 75% of 126 apartments = 94 payers @£59 per month each = £5546 hmmmmm ?? £3K for salaries - for who ?? the gardener is paid and the pool man is paid |

| Hello John I think that is a bit simplistic, and I also think pipie was being economical with the truth as to how many people were actually paying - or she was being given wrong information, but there should be sufficient funds to keep the complex reasonable, and I emphasise reasonable with just half of the apartments paying, perhaps not all pools up and working but sufficient for the needs of the complex at present. There will shortly be another consideration with the septic tanks and sewerage system to contend with. |

Surely they would want to put their point of view across with reasons as to why the site is in the condition it is. surely someone out there must be able to contact them and let them know that their name is being dragged through the muck - literally! With more rain apparently forecast for next week, something needs to be done very quickly or these poor owners will surely suffer more heartache. | It is not just the cost of looking after the pools and the gardening. There is also the cost of communal water and electricity and the upkeep of the management company's equipment and I am sure many other things to consider.. However, I would not have thought it was for me or anyone else not on the site to be discussing these details. The only way to move forward is for the majority of sensible people on the development to get together and discuss their next move and ignore the trouble makers as they will never change wherever they are. |

| All costs and expenses of all outgoings should be available via the MC if they are abiding by the law, so that you know exactly what is left so that monies can be directed where appropiate to bring the facilities back up to working order. If the Management Company are using their 'own tools' then they should upkeep them - if they are the sites tools then yes you will have an expense to keep them in working order as we do on our site, all tools have been purchased from our fund money and used on our site This is an open forum and therefore this thread is not dedicated as an owners only area or have I missed something surely therefore can be discussed openely - thats the whole point of forums I am sure when they wnat to discussed something as owners only they will refere back to their own forum |

| Hi Isabella and sienna, I did in message 35 mention communal electric bills but not communal water which should just about wash its own face but if not it is included in the £1K other expenses. The M/C using their own equipment may not have crossed the minds of those who were castigating previous efforts, but no doubt by the deafening silence we can take it that this war of words is now in the past (hopefully) The majority sometimes get drowned out by the minority, but some so called troublemakers just need to study things from a different perspective to see the gains that can be made by co-operation, not all of them are just TROUBLEMAKERS !! jay76 your input is so welcome :( |

| Project Name: TURQUOISE BAY RESORT Report Period: September 2010 The sand in one filter in Kings Bar pool has gone hard and needed acid in it to break it up. Filter emptied and new sand installed. The top pool is running normal and is crystal clear and clean. There is no overflow in the balance tank of any of the pools and when it rains heavy for a long period there is the chance of flooding the pump room resulting in pumps being burned out, this needs to be addressed soon, but as the fund is low money is not available for any capital expenditure works or projects. The entrance to the Gym and pool area is via stairs to the basement area of the apartment block adjacent to the on-site office which has no drain at the top of the stairs has resulted in rain getting in this area and down the stairs causing some damage This has to be addressed before the next winter rains, but as the fund is low there is no money |

| If there is a contract with the managment company - sue them!!! People say that this is a waste of money - but the hassle it gives them is worth it as they have to deal with the fall out. Also get a load of publicity - using there name - give it out on here NAME AND SHAME THEM and you will find they will try to shut you up by doing 'some' of the work. |

| HildySmith I think the point that John is trying to make here is not about the M/C not doing the works, it is about people not paying their maintenance fees, the fund was non existant at their last presentation of monthly account, and it is quite simple, if there is no money then there will be no maintenance. My amazement at all of this is that the complex was well warned by the last M/C that things would end up like this, and that was before they pulled out of the place, there were a small band (I think 4/5) that were unhappy with the way things were handled when the developer contracted the last M/C to run the site, they refused to pay, which is well documented on here, that coupled with a couple of large investors who were not contributing, led things to collapse before, and I thought lessons would have been learned, but obviously not. |

| Without money coming in this will never be resolved but proberly only get worse if its not got to grips with a. the place will fall further into disrepair b. people that are paying may well stop when they see there money going where ? If you have non-payers they can be taken to task now under the new law ok not tried and tested but somone has to be first off the starting blocks ! next question, so why are the committee not working towards, with the management company, to getting the monies in ? follow the process before its too late would be my advice This should now be the priority of the site surely get the monies so you can priortise the works required along with chasing the developer that has left the site in this mess. no money in - no site maintenance, not matter who the company are. If there is a contract as suggested above which there should be - if not why- within that contract there should be the obligations of the owners to pay the fees |

| also going back to message 43 a bit like the chicken and the egg, - what comes first - if you dont spend the money on stopping the water ingressing into pump rooms, filters, indoor swimming pools and gyms etc then ultimate the end cost will be far more than the remedial work. We did find on our site simple solutions for some flood defenses that directed rain water elsewhere, preferably the storm drains to avoid this Your site is in a right old pickle !! - If I was on this site I would expect an EGM to be called and ASAP personailities - old history - blame although there need however to be pushed aside to get this one sorted and sooner rather than later - surely thats what you all want including the current MC, no one wants to see their investment in this state with not light currently at the end of the tunnel. |

| Sienna Most of this could have been avoided if people were given time and the non payers had paid from the start, they were well and truly warned what would end up happening, but as usual some were not listening, it is the old story "I didn't say it was your fault, I said I was going to blame you" I can visualise roughly where the site would be today if things had been allowed to progress till the end of the contract which would have been up in May past, but there is the Esentepe 1 - unfortunately ! However the present situation is useless, the M/C said on here that the committee was democratically elected, sorry it was not ! The present committee interim or otherwise have been in position for a year and there has been very little movement at all ! We are overdue for an AGM why ? THESE THINGS HAVE TO BE SORTED sooner rather than later, we cannot keep going on promises of maybe and sorry theres no money in the kitty, is it perhaps that the M/C are taking too much themselfs |

| Sienna Messages 47/48 there seems to be a fair bit of apathy among the owners on the complex it would seem many of them are either afraid to speak out and stand up to the constant whingers, or dont care either way, the present (interim or full) committee, have been in place for quite some time but as said above a couple of e-mail letters in twelve months stating that the M/C are in discussions with the developer and the investors to see how best to tackle things is simply not good enough, action needs to be taken immediately on site, a suggestion that has worked on another smaller complex, if all the owners pay an extra months fees, that would raise around £3500/£4000 to get a contractor in to sort out the flood prevention and balance tank overflow problems, and do some of the repair works to the pavements and road, this money could be viewed as a payment to account, and the owners could get a free month at a later date to be set, as there is no contingency fund in place |

| How about suing the building company, they shpuld be paying a lot of the maintenance fees as legally they still own all of the unsold apartments, as owners they should be paying maint charges. |

| japeal you are not wrong .. but as they say a long drawn out process. rightly or wrongly Lazy days good idea for a quick fix solution - a contingency fund is always good for emergency repairs, again we do have one on our site and has been used for emergencies - it may be a way forward. You always get some owners that are not bothered and just want to rock up for their summer holidays, however they are going to have a shock turning up on Turquoise Bay. As said owners need to take responsibility to what they signed up for and stop the apathy - it doesnt work like that, but yes you get apathy on all sites, but apthay gets you know where |

| The 15th has come and gone and still nothing on the M/C website as promised ? I think the idea lazy days has come up with is maybe not the best but certainly the only one that has been put forward to try and progress the complex. I would like to see an extraordinary general meeting called immediately, a proper committee elected (with local knowledgable representation if possible) letters and representations to the developers to put right the defects on the site forthwith, this should also help them to offload their unsold properties ! The committee being proactive in telling the M/C what they require to be done for the fees paid to them and a timescale for these jobs to be completed, if the M/C do not want to continue under these conditions then the complex maintenance be put our to tender, with a clear definition of what is required of the M/C and the amount and type of fee that will be payable to them by the floor owners. |

| Hi johndp, Having had time to digest the above comments I would like to voice mine for what it is worth:- I believe that a new committe should be elected democratically who have the interest of the owners at heart, The developer should be brought to task about the state that he left TQB in. How can the owners be asked to repair fallen walls when he clearly has not built them correctly in the first place. NO electricty supply to D block as I write this. Why did he install a pump in D block pool knowing full well that it could not be tested. I looked at the pump in October and it was under water and no doubt it is US. What about the ground that has sunk on the apartments on the valley side LAST YEAR. He is not a man of integrety How can he expect to sell any further properties? | Until you separate the two - developer and maintenance you are not going to get very far. You need to pay your maintenance message 57 otherwise you might as well all close up your apartments and stay at home as your site will eventually not be habitable. Your next stage is to put pressure on your developer. |

| Hi John, I took your e-mail from you profile and e-mail on its way But have to say this cant be put down to "a man of integrity or not" this is a company we are dealing with, that PROBABLY haven't got the money available to do any more works on the site, possibly because they are owed money from an overzealous investor or two, only surmising the scenario but if true then theres not a lot we as owners can do to rectify that particular scenario unless as a group we take legal action to put memorandums on the properties not contributing for the outstanding amounts due and together with compounded interest of 8% till settled this might just waken those non payers up Isabella, it is already that way, :( |

| I have left things to see if as promised the M/C on TQB would give us the promised update on the 15th of Jan 2011, it is now 5.45pm on the 19th of Jan 2011 and there is no information or update on the website nor are we gettin answers from Lynx, I need to know why there is no update on the maintenance monies since November 2010 when we are supposed to get a monthly update, and there is no update on the maintenance report since September 2010, so come on what is going on ? are there problems that are not being shared with bona fide owners and what the hell are the interim committee doing ? | Another thing noted is the fact that the part time gardener has been noticeable by his absence on the complex this past week. | Scoty My friend went into the M/C office in person and asked questions on behalf of an owner on the 11th of Jan. questions which he had written for her, she was told that they could not answer them, but that everything would be posted on their website on the 15th, it is now the 22nd and alas still nothing as yet, no update to the site account report, no update to the last maintenance report which was dated Sept 2010, we do not wish to discredit but something is very wrong here, and to back this fear up, on another site where my friend owns and the same M/C operate, the site account report was updated as normal, so I must call into question their policy of openness and transparency which was the main theme when they were un veiled as the new M/C Perhaps someone from the M/C or committee (interim or otherwise) would care to comment ? or dare I say they have also been made unfulfilled promises. |

| I think all the myths and untruths have been blown apart, the not genuine photos and photos of a pool that was never in the equasion in the first place, the builders camp outside the complex etc, the so called openness and transparency when OWNERS ask questions and are told nothing by M/C. Well here's my take on this, the M/C are in the exact same position as before, false promises of things being done, this cant be allowed to go on for the next year, same as I said last year, but nobody on the place listened, its not good for the struggling businesses on the site, it's not good for the owners and there kids (danger everywhere) ACTION IS NEEDED NOW. |

OK in response to this statement from Lynx, it is to be supposed that there are a number of non payers AGAIN, why are you not naming and shaming them as you are doing on other sites, or are you afraid of the consequences. To a certain person, lets hope you can see all of this in a proper light now and maybe just maybe you will finally realise that you had a good deal before, and a team that were working damned hard on behalf of all owners - eh ? | This latest post number 70 strikes me as absolutely incredible, people ask open and forthright questions of the M/C and do not get any answers, yet they come on this bulletin board with a repost like that. Let us now reflect as JDP said, there is a very sad but true similarity now apparent between what has gone on in the past and what is going on now, the difference is the present company took a little longer (almost twice the time) to expose the problems of non payers, the last company chose to tackle them individually but the present company choose to post it on here, however the problem is the same, and as before the M/C is running out of patience. | A possible solution to all of this may be for the large group of owners who are paying faithfully, to put a fighting fund together to take the non payers to court and have memorandums placed on their properties, the compounded interest and legal fees placed against them may just make them wake up and smell the coffee, however this will only work if ALL non payers are tackled, not just a chosen few. | Tuquoise bay owners now have access to a communication system set up by committee and Lynx. Turquoise bay owners need to Contact lynx ASAP for access if you have not received information regarding this . On a personal note the promoting of a forum for communication for Turquoise bay owners by the previous failed managament company is completley biased and is not in the best interest of any Turquoise bay owner. | More ! but there is a little repeated stuff on the maintenance report but nothing new. July/Aug/Sept/Oct/Nov all showed a deficet on the account report and they seem reluctant to publish December, i wonder why ?? could it possibly be that for the sixth month running the account shows a deficet and they have everything crossed that the "investors" pay up, why else would they post what they did in message 70 and it also blows away your claims that 75% are paying on site so enough of your "*ullsh1t" The M/C will continue to chase up ***** IN THE HOPE THAT MORE WORK WILL BE FINALISED IN THE NEAR FUTURE, we have been hearing this for 18 months now, enuf is enuf. |

| An unbelievable response in message 70. Especially to people who had clearly stated on the forum that they had fully paid their fees vut that they were concerned about the state of their development. It gives a very clear picture of the management company to people who are not connected with the development but have been following the thread. |

| Since buying in Northern Cyprus I have always - despite what others may think of me - been fighting for what is right for owners, whether that be bad management or developments left unfininshed and more importnantly for the rights of owners, by way of committees and ensuring that MC work for owners not hte other way around What I will always debate is the point whether OWNERS money is going to the best use of the site - that means full transparency from any MC With the Floor of Easment Law there now is a legal route, maybe not tried and tested (soon will be ) but a procedure to follow to bring non-payers and MC to task I would suggest you on this site follow it - it is clear some want too so why not !? it has to be If as message 70 says there are non-payers I ask again what are they doing about them - maybe they cannot do anything as they have not followed the process if this is the case - Then you as owners need to start again so you can firstly bring these to task |

| Sienna, exactly what I have been proposing as well, but it must be done properly, there have to be steps taken, the first of which is an EGM where a properly elected committee is put in place, following the proper procedures, a book of owners put together and properly registered with the land registry office (may be problematic in the future for some people) a scope of works laid out, a contract written up and tenders requested by management companies to carry out the works on behalf of owners and their charges for doing these works to the spec. then maybe things will be on the right track to move on to the next stage of putting pressure on the non paying owners, however I emphasise again that ALL owners on a complex must pay (no grace and favour) |

| Can I ask a question here Just to paint a picture the way I believe it should be The developer builds a site of 100 houses, and sells off 45 to individual buyers, 30 to investor A, 10 to investor B, 5 to development directors, he has 10 left unsold. In my opinion there is 10 unsold properties so there are no owners, is this correct ?? In my opinion the ones sold to investors are sold to them as owners owners, and these investors should be paying is this correct ?? Places kept by developers for their own use, should they be paying ?? Please sensible debate and answers only |

| My opinion message 95 yes they should Investors whether individuals or companies will benefit or not from a well kept site. If the site goes in to disrepair as in TB case then this devalues ALL properties not just 'normal' house owners LD may correct me as not 100% sure without checking but I do believe there is a clause for them to pay under the new law ?! | Sienna message 94 It is admirable that you have been fighting to bring things up to European (better) standards in the TRNC and you should be applauded for your efforts, unfortunately with most of these bulletin boards many of the threads with suggestions end up as insults against companies or individuals, and we have all been guilty of this, some more than others I might add. In my opinion most companies out there are reputable and want only the best for their clients, but this is (was) not a modern day European country and was the reason we purchased here, we realised that there were not going to be houses constructed to EU criteria, we realised the roads would be forever till they were finished, we realised the electric would go off many times, we realised the shops would not have every conceivable appliance people would need, but that is why we chose to live here, now however after almost 5 years, we have had enough of this modernisation and soon we will go elsewhere Cont:- |

| So how come messege 95 has not been put to present maintenance company committee and all owners on Turquoise bay. ? it certainly is not on the communication site. Yes the right way to go but surely this information needs to be put to each individual owner committee and Lynx. |

| The Thread is OK as long as the on going battle between posters doesn't get personal although it baffles me why this is repeatedly fought out on 44 when there appear to be other specific methods of having a discussion. Instead the same old questions keep being brought up and no one appears to want to move onward. Johndp you cannot really complain if Pipie joins a thread when you made a fairly specific reference to her in a post can you? There have been some good suggestions on this thread it appears to me, mainly about non payers. If the contract goes out to tender at some stage in the future, will it be on the basis that only X% of the units will pay? Again it strikes me that any management company would struggle in such a situation. From the outside it appears that all concerned with this development should stop squabbling over who said what to who and when and agree a way to deal with the most pressing fundamental ongoing problem. | AJ this thread has just got personal it doesn't keep getting personal, ask yourself some questions and look at how many good posts were on the thread before it degenerated, then maybe you will have your answer. I think it went to 83 before an imposter threw in some myths which were soon outed as lies, then it progressed to message 99 where a non owner came in and asked questions and made points which were inflamatory, these were challenged in message 101 and still have not been answered but the slanging and accusations from the past have all been dragged up again in the last 20 posts, enough said, the originator of the thread did ask for it to be closed as it had been addressed, and lets face it many threads are closed for this self same reason - topic addressed and no need for further posts, !! |
