Unfortunately this is indicative of the way that the TRNC property market is heading.



Realistic pricing....by which I mean dirt cheap.....is the only way that buyers will be persuaded to take a gamble in the shark pool that is the North Cyprus property market.

Good luck goingback lots of expats live in there places with no deeds for years with no issues, then sell and move on for the next owners with out any problems .No one needs the deeds if the price is right.i would rather have your villa with no deeds than any off plan place that might never be built.How many of the no deeds no money group are the ones who paid up front for nothing.

Well if that "small detail" as you put it could lead to your property being repossessed and you being made homeless then I think it is something you should worry about !



The FACT that lots of people live in their houses without deeds only compounds the problem!

They do not OWN it....the deedholder does !

All I would say to prospective buyers is BEWARE. there may be no memorandums on the property now, but you could easily end up with this scenario and ultimately lose your home. It doesn't matter if the contract has been registered any so called debtor can go to court and get a memorandum even, as in our case a very dubious one, which has effected 17 home owners. It has taken us all long months to try and sort the mess out and cost us all extra, we're all now just hoping that despite the extra cost we are close to getting our Deeds which will give us some added security. Please BEWARE BEWARE.

If I had been aware when we purchased our home back in 2006 of the potentail pitfalls I certainly would not have purchased as we did. You could end up paying very dearly for the house in the long run and even face losing your home. Just read the threads about the homeowners who have lost everything and take note.

I understand exactly what you are going through at the moment! you or a member of your family have health problems and you need to go back home?



I am really not trying to sabotage your exit from the TRNC, but I have to try to get any future victims to understand the implications of giving their life saving to anyone in the TRNC! there is no protection for them! I understand you gave the asking price to the builder, and the landowner has been paid but they (whoever buys your property has NO PROTECTION whatsoever until they have the DEEDS!



Why haven't you got your DEEDS after 7 years?



As long as any future victim understands the situation! and understands he/she is only paying 55K because there are no DEEDS that is fine!



May I wish you the very best with your health problem! there are many who had no choice but to walk away, with dreadful health problems!



My mantra is still "NO KOCAN NO MONEY"

Lets hope the much reduced price will attract a TC buyer.The contract will then be written in such away as to ensure no deeds and no money. The TC's and their lawyers rarely ever purchase without simultaneously changing of deeds on receipt of all monies.

In all fairness the seller has truthfully warned all interested parties that there are no deeds, even after 7 years. You can't complain about this, people are going in with eyes wide open.



If only builders would admit this when selling their property.

Don't know about you but most people when paying for a house expect to legally own it. Without the deeds you can't actually achieve this.You can buy my house if you want, on the same condition. You give me the money but I continue to own it and when I can't pay for my new house and car I will use this house as assets for the bank or people I am in debt to



You will only guarantee, having a roof over your head, if the builder gives you the deeds and decides not to pay off his debts via a memorandum.



There is no point comparing the cost of this house with Spain or South Cyprus. Unless you are comparing it with houses that the seller does not own also.



Wake up smell the coffee and realise that £55000 is a good buy for a legitimate purchase but not if you lose the house and the money after a few years.There is no guarantee that this won't happen.

Memorandums take precedence over registered contracts, goingback.Therefore you are not safe.



I am not scaremongering simply stating the facts. I hope everything works out well for you but I'm sure you want a buyer that does not feel aggrieved. I admire you immensely for coming clean about the lack of title deeds, most sellers would have ignored and hidden this fact. You have been honest and all future responsibility for anything that happens will be the purchasers, who will now be going in with eyes wide open.



Yes I am very aware of the title deed problem in the South, but 2 wrongs don't make a right do they?

There was a time when Estate Agents refused to sell without confirmation of deeds. See previous threads from sellers about this) A few are still doing this. Many have now had a change of heart. However I don't think they realised just how many didn't have deeds!

It is very obvious that your back is in the corner to sell for that price and I totally sympathise with you and your husband. I see that you are a new member on here and apologise for the replies that your posting has attracted. My advice is to ignore the nasty comments.



Perhaps all of you 'helpful' people who have posted here could put themselves in this ladies position and show some compassion. How many of YOU have deeds, or indeed how many of YOU own property in TRNC?



As has been said before by MANY estate agents.... 'Deeds are only a formality, you will get them eventually'

Deeds mean you own the property. Living in a property without getting your deeds means the builder still legally owns it.



When will the message get through that it is of paramount importance to get those deeds? They are your only safety net.

We own the property, all taxes are paid and the Pre-74 Turkish Title Kocan is in our name.



Having done all the research 6 years ago we thought it safest.



Fat lot of good now, we are in the same position as the people who have NO DEEDS, maybe worse because we paid extra for the title. Now we can't sell it honestly to anyone other than a TC.

You have a legal title deed and one that is 100% internationally recognised. Trust me you are in a very good position. Yes you may only be able to sell it to a TC but that does not necessarily mean at a low price. Most TC's will only buy pre 74 and as they become rare you may well find demand dictates the price.



No matter what the settlement or if things continue as they are............you are completely safe. Deeds on Pre 74, you really are lucky.



If ever you advertise it, do it in the Londra Gazette. Its not as gloomy as you think.

I know this villa and the people selling it.



At 55k it is not only a bargain, it is an absolute steal!!!



The deeds are only just around the corner ( everything agreed with land owner). There is no mortgage against the property; and there can't be because the contract is registered at the Land Registry.



The only reason for selling is his declining health problems. The house is OK.

LUEM1 message 82 do you not read the messages let me spell it out for you once again. Even if your contract is registered memorandums/charges can still be placed on the property. It has happened to a great many owners including myself and you won't necessarily know there is a memoradum on the property until hopefully you get to the stage of agreement from the landowner/builder to transfer Deeds.

And believe me you have to pay the memorandum otherwise you don't get the Deeds.

So once again I would suggest if anyone is interested in this property at the very least engage an Advoate and ensure they check with Land Registery for possible Memorandums placed on the home, not forgetting that at any time prior to getting the Deeds you are susceptible to any person who might be owed money by the Builder/Landowner placing a memorandum on your home.

That is an interesting idea but not a route we would desire to go down' for many and varied reasons that have been discussed on here .



We have a viewing tomorrow, fingers crossed.



We are a little puzzled over 40 requests for details but no feed back from those it has been sent to.



IT HAS BEEN CHECKED THERE ARE NO INCUMBERENCES ON THE KOCHAN .

Goingback....I'm sorry to hear of your increasing desperation regarding your property sale.



As is often the case there was an initial flurry of interest from those eyeing up a "bargain",but unfortunately confidence in the TRNC property market has sunk so low that even at £55K ( you wouldn't get a lock up garage in London for that ! ) you are still struggling to sell.



Hopefully you'll find a buyer...someone who is willing to take a gamble on the deeds.....but your predicament should be a salutory warning to others who still view the TRNC through rose-tinted specs.

It is possible to buy a house without deeds, in fact it is impossible for YOU to get the deeds without Permission to Purchase if you are a foreigner. Look at all the off plan sales, yes the builder/landowner/seller has the

deed to the land, allbeit, they may have borrowed against it before/during of after you bought it, simply because during the time of parting with the cash and you getting PTP, it remained in his/her name. Oh yes, you registered your Contract, well that will not stop a Court Memorandum being put on it if he/she fails to pay

any of his debts. It shouldn't happen, but it does.

I sense your frustration again !



You have been honest enough to admit that although your villa is only £55K, it will cost someone another £20K to the landowner to get the deeds.



However...there would be no point in YOU getting the deeds and then selling for £75K because deeds in YOUR name are not an automatic guarantee for a potential buyer.

The buyer has to apply for PTP and get the deeds in THEIR name.



Some people think that buying a resale off an ex-pat with deeds is 100% safe....it is not.



Good luck with the sale.....there must be someone out there willing to take a gamble at £55K.

The buyer may be a tough negotiator or may have some leverage to persuade Behzal. H. NalÇkanoĞlu that it is a good thing to honor the contract he signed and he has already had extra money ie $25,000 mortgage paid off,

I believe that goingback is one of the few honest sellers in north Cyprus, they are selling at a price that reflects their situation. If you buy from an expat returning to the UK who is using the cash from the sale to buy a house there it might be possible to place an encumbance on that UK property to the value of the villa, removed when deeds are issued. Tricky. At the worse the UK house would have to be sold and money and villa returned. Just thinking about ways that expats might get round the no kocan no money problem.

take two steps back - there are plenty of folk with a few quid in the TRNC - it the place represented a bargain investment - it would have sold the first day..............

If anyone is genuinely interested in this property I would suggest it may be better of taking up the offer of £75K to INCLUDE clean deeds.



The reason being that the honourable gentleman who is wanting another £20K for the deeds may suddenly decide that the new "owners" look quite well off so he'd now like £30K, or £40K, or £50K......etc



The fine,upstanding TRNC "legal" sytem would obviously support him fully in this course of action !

If someone buys goingback's property without its Kocan, they could put a charge on it equal to or above its value with a Kocan, then if anyone looks to put anything on it, by way of a court memorandum by a creditor of the existing name on the Kocan, they will find a Contract lodged and a charge and will realise they are wasting their time. Third in line!!! IN any event the new purchaser is first and second creditor on their own property/

pretty safe, except from a Greek..........which also include us all who have bought on fromer Greek land.

I may be mistaken but my understanding was that you could only put your own charge on the property you are buying WITH THE CONSENT OF THE CURRENT DEED OWNER ie builder/developer/landowner etc.



Most of them are reluctant to let you do this...for obvious reasons....because then it is no longer a useable asset of theirs !

You are right cronos, you would need the agreement of the person named on the kocan at present, that could be the fly in the ointment, be worth goingback making enquiries of him/her., worth a try.
