Myself and my husband made Cyprus wills in 2004 and due to family circumstances we both need to amend them. Do we have to go back to the same solicitor ( Gurkan) or can we use a different one, or can you just go to a notar?

I have just downloaded a template for a will and going to do it my self , it is alot cheaper and there are guidlines as to what to do easy.



Have you made a TRNC Will?

It is imperative that you have a TRNC Will lodged with the Courts. We can supply you with a basic Will template in English which you can do yourself.

You need an original Will, 41 lira (34 for Will and 7 for Register) Post Office revenue stamps and a brown A5 envelope. You must go to the local Court office with your passport and two witnesses with their passports and sign the Will document in front of the clerk. The details are recorded in the register, the Will is stamped and put in a sealed envelope and you are issued with an official receipt.

The Court office is now only accepting Will registrations on Mondays, Wednesdays and Fridays are, during Summertime, are only open in the Mornings.

If your lawyer has already prepared a Will for you please ask them for the Court receipt.

Yes. as I said we made TRNC wills in 2004 and need to either amend or make completely new ones. They are lodged with the courts. It was rather expensive at the time and would appreciate any advice on keeping the cost down!

I would take a copy for your ref and you will be given a receipt.

For good advice email/talk to Ismet and pay his wifes reasonable rates as an able Advokat.

BTW if I'm right a new will will not be good unless the old one is destroyed, ask Ismet.

There is only one way to do it:

Make a CODICIL

in which you can

a. "cancel" your WILL (make an annulment) and

b. make the new WILL or

c. change any paragraph in your WILL (2004)

You can ask any lawyer to set up the CODICIL for you, if you don't want to do it your self. It is not enough to sign in front of a notar.

We did exactly the same as Schoie.



The court officials will destroy your original will, infact they tore ours in half right in front of us.



It is all very very easy and the cost is a fraction of what any lawyer or advocat will charge.

We used our original wills, re-typed them using the same wording plus the changes etc and lodged them at the court ourselves. They are very helpful and check it through to check it is acceptable and covers all the legalities. We then paid for the stamps to cancel the original wills and lodged the new ones with just the cost of the stamps. We kept copies which our witnesses also signed and dated on every page.

1. It is customary to cancel all previous wills with your latest will. So you do not have to chase and find the previous ones.



2. In Famagusta court, you submit the will in an envelope, they put it into another envelope and seal it. In Girne court they want to check it before you put it into an envelope. In my view Famagusta practice is more correct. Suppose the person making the will wants to keep it secret.



3. I suggest that anybody making a will over the age of seventy get a doctors report for sound mind from a government hospital.



4. Make sure the wittnesses are not beneficiaries or the spouse of a testator.

We had two wills proffesionaly done about 2 years ago although copies they were complex due to charities being involved. Cost just under £200.00 by Dolun Ismets wife and the time they took to get them right I think we had a bargain.

Reading my message 14 I did not make myself clear.

They kept on taking time fine tuning the phrases to ensure our intentions were sound until they were happy our wills were "lawyer proof" . It took much more time than we had anticipated!

The service and attitude was well worth using Dolun in Famagusta even though we are based in Lapta when on the Island.
