| I am seriously considering buying a unit in Aphrodite Phase II, and wonder if anybody who has bought into the development had problems with Title Deed issues. Even though they advertise "Pre-74" I wonder if someone has determined that they are the actual owners of the land and if they issue an appropriate Title Deed before or shortly after completion. What happens if political changes on Cyprus take place and a unified government takes over? I also wonder if they work successfully with other legal entities besides the Sener Law Firm, and how Sener has done for those who have chosen them. Thanks! berserker Jan. 2011 |

| Berserker....I am not an expert on this development in particular but know that it is indeed Pre-74 Turkish Title Deeds. Unless you are a Turkish Cypriot, which judging by your name you are not, then you will not receive Permission To Purchase as a foreigner, for any property with such Title Deeds. You will be allowed to purchase, and pay outright, and maybe even move into the property, but without PTP you will never get the deeds in your name, so you will never legally own it. Please use the search engine at the head of the page and type in Pre 74 or similar to gain much more information about this covert policy of the TRNC government. |

| No deeds are water-tight in the TRNC. Are you aware that under TRNC law the developer has no legal obligation to hand them to you even though you will have paid in full? I suggest you read about memorandums and as a victim of the Pre 74 scam, who looked at every way possible to solve this problem, I can say with certainty that PRE 74 are not issued to foreigners. See HBPG. |

| How many times will Seners act for people buying Pre 74 Turkish Title deeds, knowing that they will be met with refusal? Wouldn't it be refreshing to see some honesty from the advocates? |

| As long as they (THE ADVOCATES) are not legally binded to pass on information about pre-74 deeds, then unfortunateley Sue it will carry on, Paul. |

| They hide behind the fact that there is no OFFICIAL govt policy regarding refusals.....they haven't got the guts to admit their shameful actions. Therefore the advocates can't advise you about a policy that doesn't exist, even though they are fully aware that your PTP application will be refused ! |

| Yes I know Paul, The Government should come clean. However this won't happen because they would be seen to be blatantly discriminating. The fact that most advocates are still not coming clean however confirms that they owe no duty of care to their clients. |

| Hi Berserker Understand your dilema. I have an apt on Aphrodite. I must say I didnt want exchange title and when I bought there wasn't a problem with PTP. My understanding now is the majority are being refused. This is purely political and if there is ever a settlement or a pemanent partition things in my view are likely to change but not until then. You can still rent out and sell your property without your deeds. Bear in mind the price you are paying, the cost of a luxury caravan in the UK. If a political settlement is forthcoming and PTP are given prices will rocket. I bought my apt when the development was half built and the prices have risen significantly. So all in all you have to decide. To get the same size of apt in a fantastic location on the beach would cost significantly more elsewhere in Europe. I have a copy of the deeds, verified by a solicitor which confirms the land is pre 74 regards Linus |

| Linus.....you've bought it, paid in full, moved in and are enjoying it. You are right, you CAN rent it out and even sell it. HOWEVER, you do not OWN it until you get PTP and deeds.....and that is highly unlikely. It is still owned by the developer...it is HIS asset, and can have memoranda placed on it by any of his creditors. I wouldn't hold my breath for a "political settlement" and "rocketting" prices either.....Sorry ! |

| Don't dispute anything you are saying Linus. However in the above situation you do not own your property, your developer does, even though you have paid in full. You remain at risk of memorandums if your builder has financial difficulties, or as in the case of many builders, just does not want to pay his debts. All in all not a good position to be in. Added to this the court has ruled that memorandums take precedence over registration of contracts. Put purely and simply, its a gamble with no certainty as to how things will pan out. The property market is also in a very precarious position with studies showing more people are choosing to rent rather than buy. This is particularly true in Cyprus because of the poor publicity and many property scams. Property prices are falling throughout the Med. Cyprus property will only ever be a sure bargain if you actually own it. |

| Not all Brits have been refused PTP on Pre 74 Turkish title. Ask your lawyer for guidence on this development. You can go to the south lands office,with a copy of the deeds/ land and they will tell you if it is or is not genuine Turkish title. |
