I so wish I could be positive, and yes I realise there are many other posts that deals with rubbish lawyers, but I really don't know of any lawyer within the TRNC that has a "Duty of Care"!

Beekeeper....may I suggest that you ask only for recommendations from people whose advocate has taken them right through the buying process from initial contracts to registration through PTP and receipt of deeds?



Previously too many folk on here were too quick to recommend their advocates even before they had actually taken possession of their properties !

We are using Sener law firm for the second time.

The first time, my daughter got her ptp after a year. The sale went through efficiently. No, she hasn't her deeds as yet. There was a problem with parcelisation, but the builder is sorting it.

Also, when lots of people were panicking about their contracts being stamped, I phoned Ayhan,

only to be informed that she had the contracts stamped as part of the service.

This second time, the sale has almost gone through within a month, but she has found a small problem

which is holding it up. She found the problem, I might add.

They also have offices in London, and speak excellent English., I can only speak as I find, give them a call

and speak to Ayhan. Her secretary's name is Pembre.

I have been dealing with Naomi Mehmets office for over a year now with regards to my property purchase(s). We have tried to buy several properties over the last year and luckily for us Debra Dolling at Naomi Mehmets Debra has done her job and found the problems with all of them. Debra has been fantastic all the way through and given us all the information we could ever need to make an informed and thankfully correct decision. I would recommend them to anyone.

They are not all bad and there are some very helpful and trustworthy solicitors/advocates out there.

I would use S & A Advocates, they are based in Karakum opposite the lemar. Alessina there is really good, she qualified in England and she has works on my file for years and i have never had any problems.

They have office's in lefkosia also and are a well know company

We used Peyman Erginel who for us was fantastic, she had the builder and us in her office to go over the contract prior to signing and was there every step. Our PTP was aquired within a year and our kocan was ready approx 5 months after completion of build. Additionally we had some problems with our pool which the builder failed to rectify although he tried and Peyman instructed us not to pay the final monies we had withheld, her suggestion, in order that we could get someone else in to get the pool right. One can only go on ones own experience and I personally found Peyman on top of her game.

Just for interest there are NO SOLICITORS in the TRNC Just lawyers/Advocates. Whatever you do DON'T PAY THE LAWYER any monies until each stage of your transaction is completed (don't hold your breath)

HOWEVER

Important to do own independent research

Best days work I did was knocking on ex-pat doors and listening, learnt an awful lot, most of it good but some bad.

It is perfectly possible to buy safely here, it is also easy to get stuffed.

It's always good to hear a "success" story....but could you tell me:



"PTP done"....do you actually have PTP or has it just been applied for on your behalf?



"Kochan in place"....is the kocan in your name or have you just been told it is "ready" ?



Finally...is your property on Exchange title or Pre 74 Turkish Title?

At the end of the day the advocate can be brilliant but if the builder / developer / landowner is not in any way reasonable then the advocate is stuffed. It is only then you find out if they are capable or even want to litigate on your behalf.

The recommendation needed is an advocate who has done their job right through to the end and handled the problem developer and obtained Kocan and a satisfactory build.

Anyone spotted such a rare beast?

Have PTP, took about 15 months,slightly delayed because Peyman and builder had to sort out access. Which was done and the PTP was then granted.



Kochan in my name and I have seen it!

Original help by Peyman with TRNC Will



The land registry will come and inspect land and property before kochen is issued,don`t make any major changes/improvements until after Kochen granted



Exchange- not even Peyman can minimise the risk you take there.

But for me an acceptable risk-personal decision

I was recently in Court and the Judge asked my why Sener Law Firm were not in court in the dock as they had caused the mess and should be in the court too.

H & A, are doing a fantastic job of getting us out of the mess.

Naomi Mehmet, saw us through the lot, buying, lots of problems with contract as builder picky! PtoP in a reasonable time and we now have our Kocan, with our names on it (last spring) - all done since October 2008

People will never learn.

1. As it stands with the Specific Performance Law, no advocate can guarantee a successful outcome.

2. Be prepared to employ an advocate independent from the developer/seller.

3. Be prepaded to pay the advocate for his services even if the outcome of the negotiations is negative. Otherwise he is more likely to accept the developer's conditions and finalize the negotiations positevely.

3. Be prepared to take your advocate's advice and find another property i.e. don't be lured by the sales talk and accept the developer's conditions come what may. For instance if the developer insists that you pay all the money when taking over the keys you walk away. I would reserve at least 10% to be paid with the title deeds.



If things go wrong, be prepared to blame yourself. It is always more convenient to blame somebody else.
