Hi, I have to pay my builder's 6.25% taxes as he is refusing to sign the villa over to me unless I do. I have heard there is an amnesty on this tax at the moment and it has been reduced to 4.25%. Can anyone verify this for me please and if it is true, when does it end?

Thank you.

May I ask please who your builder is?

I have no knowledge of an amnesty at the moment, I am sure the Forum members would know if there was an amnesty on. There certainly was one but it is over now.

I hope you are right

Thanks for the replies.

The contract isn't worth the paper it is written on! I have tried haggling but he says.. pay up or I don't sign, even my lawyer has tried speaking to him and has told me to pay if I want it signed.

Another fine example as to why not to buy a property in the TRNC.

Rogue builders exist in every country Hector.....but only in the TRNC does the law actually support them in their corrupt endeavours !

Create a list of builders that practice this and list them here. Better still create a list of reputable builders as well.

We built with no problems, but did not use building companies. Used individual traders instead. It worked wonders.

Emineden1 do you know what the transfer tax is currently? Is it still 3%/6% or has that been reduced liked the Stopaj?

The builders tax liability is 4% stopaj on transfer. After the end of the year he has to pay the balance of 2.25%. This 6.25% is the only corporation/income tax that developers pay.

MSG 23: And then waste more money on Advocates & court fee's.

I was in in the same situation, we either paid the builders tax or they would not sign the deeds over. My Advocate said it was a breach of the contract but up til then the contract had proved worthless to me although it always appeared to be legal if it was in the builders favour.

Quite simply, if you want your deeds pay up, we did and then sold up.

The law in TRNC only favours the chosen few and Expats are not among them!
