Well I have kept pretty quite about this.....I now need peoples help to sort this big HUGE mess out. It reads better than a soap ....NO ONE COULD MAKE THIS LOT UP !!!! I will tell everything when asked BUT, I do not require clever wit ...it does nothing to help. I am based in the UK so if anyone could give me emails or tel numbers I would be really really grateful. I need to contact the tile shop at the back of the law courts....they have a plumbers shop opposite them, I need their contact number/email too. Sorry I do not have the name for the shop....wasn't expecting to have to do this. Also I need to contact the kitchen/door shop on the main drag through Girne -Lapta road. And finally I need the contact number of ADOPEN.....they are window suppliers.

gillken! Armed with all the information, you would have to set off on a mission "locate the builder" for possible legal action - whatever. It would probably cost you a small fortune in phone calls and if you are not here, not even the solicitors will do your running for you after you get a lead on the whereabouts of the other party. If this is a mess that is going to cause you some financial loss, I suggest you find someone (non-solicitor) who can do the running for you and chase the problem on the ground. It may cost you 100-150 pounds, but that is for you to judge whether it is worth doing that or not. Also you talk about Law Courts but no mention of in which town! One can only assume it may be in Girne (since the other address you are looking for is - but not definite of course). If you send me an email on turkishlessons1to1@yahoo.com, explainingthe exact problem, I may be able to advise you accordingly.

Hey to let you know. I have met up with the Landowners.MY GOD WHAT THEY SAID! Anyway decent honest people whom are happy to exchange with us all, but refuse to have anything to do with the solicitors, they have had their properties built and delivered. They want us to use a Notary NOT our Solicitors I have an interesting video, it is in turkish, I intend to put it on YOUTUBE. I was so lucky the day I decided to find them I met the Muktar whom was sitting with a TC whom is taking his builder to the ECHR Courts. He said the TRNC courts do not work. He had a house built, but the builder didn't put in the concerete skeleton just built it out of clay bricks, rendered over so you couldn't tell. The roof was put on and the building started to collapse, he took his builder to court, the builder actually won as the owner hasn't paid for the roof stage payment. I am sure you must have heard of him? He kindly gave up his day to help. Trust me there is more lol

Why so much cloak and dagger by not naming the builder, perhaps others have used this company and should be made aware.

No cloak and dagger stuff at all.....I am trying not to name and shame.....I do not want to cause anymore trouble than our site already has. I was told to be very very careful in the beginning, I did my homework thoroughly.....god how careful can you be, even my prospective next door neighbour successfully tried to cause trouble simply because I got to close to the truth!!!!! He jumped on the bandwagon with the solicitors and builder when he saw an opportunity. I have been slatted by him and my solicitor, for what? seeing and telling the truth. My solicitor went mad with me. I asked him questions....he watched me write down the answers word for word I read them back to him to confirm correct I passed this to the owners.one went mad because it wasn't the same answer he had given him, my solicitor rang me up shouting at me ..saying I was telling lies..I was out of order...hung up. the next time I heard from him he was asking for £2000 to put an injunction on the land.

I have never heard from him since...nor particulary want to...cos if you think that is bad.....you should hear the rest. Anyway the solicitors have managed to to wangle 4 injunctions on the site....when ONE would have done the same job....I have had my Permission to Purchase for 12 months.....never been told by the solicitor?? Not that it matters, cos the builder has gone AWOL after trying to convince us that he needed x amount of money to re boot the site...payable directly to him not in our contract and not via our solicitors.....I am not sure if anyone did give him any more money...we didn't....but a few weeks later he went AWOL.

Hi we had no problems at all with the builder, what happened was beyond his control.....let down by a purchaser after he had gone to great lenghs to help them. Then the reccession hit as well. No one can fault the beautiful Villas that are at different stages.....if he had just been honest with us all from the start of his financial problems it could be a different story now. I blame the advocates for seeing a chance to totally utterly take us to the cleaners.....Fortunatly for us we have honest landowners.......they would not accept the bribe of £100,000 to put the land into the solicitors name. I have most of this on Video......but it is in Turkish.

I am sorry to hear of your plight but your story will help others, new to the North, by warning them of all scenarios. I have good family friends who are TCs and maybe they can translate the video for me. .. Anyway, the story at least would be worthwhile documenting and i can keep it anonymous ish if you like

.Interesting story. My lawyer in TRNC sold my apartment on my behalf with a power of attorney given to him by me. I trusted him. He sold the flat and the payments were made to my Lawyer not me. He would have taken all the money ıf he wanted to because ı was in uk and not in a position to come to cyprus. Believe it or not but he transferred the money to my account and asked for a very reasonable legal cost. I am very happy to find professionals like this after all the bad experiences ı had in TRNC back in 2006. I have another flat in Lapta..I gave the authority to my lawyer again to sell it for me. So gilken ıf you need help ı can help you get in touch with him..

Thank You Marc.W. One of the owners saw a window of opportunity to take advantage. He tried to take control ..told us we were ONLY to contact him....the builder would only communicate with him!!! He tried to make out that he gave the builder his own money to help him out.....but he would expect us to re pay him for this...no receipts, think it was about £10k if I remember rightly!!!! Some saw through his lies, unfortunately others believed every word he said....this has caused a huge rift between us all.....some thought he had all the answers.....they became quite aggressive towards others. One solicitor had the idea of forming a business putting the land into his name....him being the majority share holder....all they were doing was transferring ownership from trustworthy owners to him costing us £££'s to do so. I believe even the advocates fell out.....greed does funny things. The other advocate advised his clients to put large injunctions on the land. One would have been enough!

We have just paid for the infrastructure (transformer) to allow us to have a meter fitted at our newish house. We paid £2.500 to Just in Karaglanoglu. The man was very professional and is Kibteks main contractor. Proper receipts were given all explained what each cost was for. 2 weeks later the transformer went in and we got our supply and meter (after having Kibtek to check that the house wiring was correctly done and safe) This is the least of your problems by the sound of it and please, would appreciate knowing whether your builder was Gilgamish or not. I do not want the name of your builder just a confirmation that it is not the same as my corrupt one.

Not sure how long the TRNC allows to enter a defence to an Ex Parte judgment but if you make an application to be heard see if you can gain a stay of excecution in the interim as sometimes the fact that an application is set down for hearing does not prevent execution of enforcement whilst the hearing is awaited. Sue, ex parte is when the Court hears from one party without notice to any other ! Some lawyers find it funny to telephone the other party(ies) about 5 minutes before the hearing and say "simply for good manners I am advising you that an ex parte application against you/your client(s) is about to be heard" !!! I used to call them "pencil necks".

You're right when you say trust no-one, but stick with Marian. She knows her stuff and actually puts in the hard yards. Others just like the sound of their voice or seeing their name in "print". And nothing happens quickly in the TRNC. Be patient.

Thanks Deputydawg. We obtained an ex-parte judgment against a developer who turned up late to the latest of several hearings to find the judge finally had got fed up with his antics and granted judgment. This was back in April and he hasn't made any attempt to have the judgment set aside since. Apologies Gilken for hijacking your thread
