please can someone tell me how safe these 74 pre title deeds are in Cyprus. i have asked before and no one seems to answer. with all that is going on over there you would think someone would / could answer. hopefully / truthfully.



with all that is going on somethings must be safe

Hi Ballistic

PRE 74 Turkish title is of course 100% safe, but unless you are Turkish Cypriot you will not get your permission to buy, hence you will not get the title deed in your name. (although there is nothing official in writing to back this up) beware solicitors telling you anything different.

There is other sites you can buy on that are under Pre74 Foreign title deed, ie land owned by anyone else other than turkish or greek, ie British title deed etc. but you will pay a premium for this. i hope this helps

Unless you are a Turkish Cypriot, it's highly doubtful that the Council of Ministers will grant you PTP [Permission to Purchase], therefore, without PTP, there is no way you can have the Kocan [Title Deed] transferred into your name. Therefore the legal ownership of the property remains with the Vendor, even if you have a 'valid' [none are!] Sales Contract and have paid in full for 'freehold title'. You will be told by most advocates and estate agents that obtaining PTP 'is just a formality - no worries!'



We got caught exactly like that in 2005. Two years later, a crooked bank manager forged our Vendor's signature [without consent] and helped himself to a large lump of cash by placing a mortgage on our property. Unfortunately, for him, he got too greedy and tried this trick on once too often, obviously upset the 'wrong people' and got himself arrested. However, it still cost us £7000 in litigation costs to get out of the mess.



NOTHING is safe - the whole place is lawless!

'No Kocan - no money!' is the only condition on which to buy ANY property throughout Cyprus!

Here there is a VERY REAL chance you may not get the Deeds.....The choice is yours

Like so much else in this thieves paradise, it is impossible to be sure. Yes, pre-74 deeds are internationally recognised and secure but whether you will get permission to purchase is another matter entirely. I have a Turkish title property which I have owned for many years and have deeds. I am given to understand that another foreigner buying from me would not have a problem getting permission. Academic, as I am not trying to sell but, is this true? I don't believe that there is anywhere/anyone here who could give an answer to this question and therein lies the crux of the problem.

There is no guarantee, whatsoever, that the next buyer of your pre '74 Turkish Title property would be granted PTP - in fact, the answer is almost a definite 'NO'! If they can't use 'proximity to a military area' as an excuse for refusal, it will be 'restricted land'.



I am the first one to appreciate their motives for not allowing TC owned land to fall into foreign ownership - but I would have appreciated, no, expected, someone amongst these fine, honest, upstanding, Muslim local Cypriots to have told me the truth of the matter. At least, then, I would have had the options of either walking away from the potential sale, or going ahead, or renting. Whatever, having lived in the South, I never had any intention of buying, and would never have bought anything that was 'in dispute'.

My daughter purchased Turkish Pre 74 property in Zeytinlik in 2006 from the then British owner, PTP took just over 18 months with no problems at all , so this begs the question , when was this" BAN " put in place ? !!!!!!! .

Do you need to apply for PTP for every house you buy ?



If you buy a property on Esdedger title then decide to sell and buy one with pre74 do you have to re-apply for PTP or is the original transfered ?

I bought a house with pre 74 turquish title deed in Girne in November 2003 . The application for PTP was made in January 2005 ( I don't know why , I have a totally inefficient sollicitor...) . I just received an answer in january 2011 : refused ! Without any explanation ! Everybody told me that it is because I am on a turquish land... It took six years for them to give me that answer !!!

Here you cannot trust anybody ... Sollicitors are just here to take money , that's all ! Everybody told me at that time : here you can buy without any problem , it's safe !!! Estates agencies continue to day to say the same , as constructors , as sollicitors .... I bought a pre-74 turquish land because I didn't want to have problems with GC , but now the problem is with TC . Why they don't want to say clearly : foreighners are not allowed to buy turquish land ? Is it a real law ? Somebody can show me the text of that law ???
