We recently sold our apartment through Ian Smith estates and we asked Gez the agent who handled the sale "do we require a solicitor?" The answer was " No we can handle everything" A few hiccups along the way but now keys and kocan were handed over ----just waiting for the cheque to be given.

Meantime my wife who has been in and out of various hospitals and is now on her deathbed in the Near East University hospital. Now our solicitor has told us that until she signs power of attorney the deal cannot be completed to transfer the kocan. ( We took Gez's advice and did not consult with Naomi Mehmet until the previous obstacle was encountered)

So here we are with my wife on her death bed, no apartment and no money with the hospital bills piling up. Does anyone wonder why I cannot wait to leave this Mickey Mouse country

Between estate agents, banks, shed sellers and incompetent doctors and hospitals (NEU not included) the sooner I am out of here the better!

Donegal Developments in Karakum deserve better than having unsubstantiated claims made against them. If you have a grievance you should take it up with them in the first instance before coming onto a public forum.

There are too many snide one-line remarks made on BBs that leave the recipients to defend themselves at length, msg2 being a classic example.

Matula, can you not follow through what they are asking you do and deal later with the fact that you were not advised properly. What are the consequences if your wife does not sign. Obviously time is of the essence for your wife and yourself and now you want to leave you need to get things sorted ASAP.



You don't want the added pressure at this time whilst your wife is not well. I do hope things can get sorted quickly for you.

Matula, I believe you should be getting power of attorney to act for your wife on the basis that she cannot sign the POA documents herself. I'm sure her doctor would support that position.

matula. I am deeply sorry to read of your straitened circumstances.



As regards to your estate agents telling you, you didn't need a Solicitor to facilitate the sale of your apartment.



When you head is clearer, you will agree, per se - you did NOT need a Solicitor. You yourself tell the reader aside from a few niggles along the way, the transaction WAS completed by the Estate Agents, as they said it would/could be. It is only because of the force majeure of your beloved wife being in such a way that she is unable to sign a P of A that you now have a problem. There is NO way any Estate Agent could have foreseen such a predicament, and if your wife wasn't so poorly, in fairness, you still would not have needed a solicitor.



I wish you both well - and your wife, the best possible outcome - while there is life, there is hope!

all you supposed 'freinds' of the original poster can hope to achieve with threats of violence and insults against other members is to have the thread closed down or even removed. Is that really your objective ? If not I suggest you think about whats best for the original poster rather than what satisfies your own self indulgence before posting.



As far as I am concerned msg26 raises some valid points. I have nothing but sympathy for the position the original poster finds themselves in, but threats of violence and caps locked insults do nothing to help this person or his wife in any way that I can see.

Is it everybody else's fault? Surely you knew the dangers of not getting a solicitor and in any case how would that of helped in this case. You would still have had to have power of attorney, surely?



I sympathise with your problems but blaming others is not the answer.

If one had never heard of the sad circumstances in which Ian and Patsy now find themselves, one would only have to spend five minutes reading some of the heartless and total uncalled for cruelness that is often posted on this site to want to run away not only from the TRNC but from our computers. Hindsight as Ian says is a wonderful thing, unfortunaley we all do not have that skill. If we did sites like this would not be necessary as non of us would have been silly enough to buy a property in the TRNC. We would have all rented or stayed at home, but hey then we would have missed the pleasure of meeting Patsy and Ian. Our love to you both, keep your chin up Ian, and give Patsy a hug from us.

I have never posted on this site and it is unlikely I will again, but I feel I need to respond to the claims made against myself and the company I work for, Ian Smith Estate agency, and to try and halt the slide into a free for all, as there are now two post’s on the same subject.



The situation that Ian find’s himself in, with his wife critically ill in hospital, is tragic, and most people’s worst nightmare. I can’t begin to imagine the hurt, sadness and bitterness he feels, and can understand he wants to hit out and apportion blame. It is a very human reaction.



The sale of the apartment has been fairly smooth, other than some last minute problems created by the purchaser. These have now been overcome, and we are in a position to conclude the sale. None of us could have possibly predicted the rapid decline in Patsy’s health, and this has made what would normally be a typical TRNC transaction, into something far more complicated, through no fault of myself, this agency or the

vendors. Choosing to have no further direct dialogue with me and deciding to share with the masses, has served no tangible purpose other that to provide fodder for people who may not have your interests at heart.

I stand by the advice that was given, regarding a solicitor. As a seller, why pay for the privilege of a solicitor reading a contract that has been drawn by the purchasers solicitor, vetted by us as a middleman, saying all is fine, and presenting a nice bill for his efforts. Most people feel the same, Ian Included, but ultimately, the choice is down to the seller. Their decision. If things had progressed as we hoped, without the unknown quantity of serious illness, then that advice would have proven to be correct. I, and all at Ian Smith, try our utmost to work for both purchaser and seller as many previous customers can vouch for, and if we do encounter obstacles, then we try to work together to overcome them.

Msgs 46, 47 and 48 are dignified and compassionate. To some of us, it was clear from the beginning the husband in this sad situation is lashing out in impotent rage at the situation he finds himself in, as most of us would, and chose the Estate Agents as the peg to hang his misery on. I feel sure - in the clear light of day, he will concur that had his beloved wife not become so desperately unwell, there was indeed, NO reason to have a solicitor. Fortunately there are enough people who can see this, and although Estate Agents often get a bad rap, and often deserve it, there are enough people who can attest that Ian Smith are clearly not amongst them.



I have NO connection with Ian Smith agency; we bought our apartment through other agents, the above is my opinion only.

I am sorry to hear of this sad tale but I have to say that I have nothing but good to say about Jez and Ian Smith's agency. I was recently told by someone who had recently purchased a property through them that she had subsequently found that she had an illness. She thought that she might have to resell the house. Ian Smiths offered to resell the house for her free of charge. I don't think you would get that offer or level of service from any other estate agents in the TRNC. Luckily she recovered her health and did not need to resell.



In reply to message 52 from Spider, when I bought my house it was on with 4 different agents at different prices. Each agent was selling at the price the vendor had instructed but he kept changing the price and did not necessarily update all the agents with his price changes. In fact some two years on after the sale it is still being advertised by one agency
