Are you allowed to run pipes from a builders well for your own comsumption - to fill pools, water gardens etc on a development that is not finished and handed over. With or without their permission.?

Is it on your land?

Is it a well properly authorised by the District Office?

Is it a well that complies with the requirements for new wells - ie is it legal (eg must be more than 100 feet from other preexisting wells)?

No its not on my land but its on communal land, within a development.

Not sure have heard that it needs to be registered?, if its not registered does this mean that it is illegal

It is a well that has been there for about 5/6 years, there is another well that is on the other side of the road that is new.

If it is on a privately owned land, irrelevant on whose name, and legaly registered, who could ask you anything providing it is being done with builders permission.

Might be worth your time to go and talk to the District Office who have been very helpful to us and three other homeowners on our site in a similar situation to what you are discribing.

Our builder had a well without a permit on communal land which has recently been passed by the District Office along with roads and street lighting as part of the parcallisation process.

We approached the District Office and made enquiries regarding the well and were told that as the land no longer belongs to the builder he does not have any rights to the well. The builder had asked us all to buy the well from him and even though we were willing, we were advised by the District Office that it is illegal to try and sell it after parcallisation.

The District Office have visted the site and have agreed that providing pipes etc are not run over the roads and we apply for a permit they are happy for us to use it.

We also have 2 home owner's on site who have well's and the District

Office are aware of both of them as they were on the site plan when they visited.

Like a lot of things here, it's not what you know...it's who you know!!!

Hope you found this helpful.
